HomeMy WebLinkAbout1987 051 CC RESO1987 051 CC RESO(Ìì÷ERESOLUTION NO. 87-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT 87-1 ALONG RAMONA BOULEVARD BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AS FOLLOWS: WHEREAS, by Resolution No. 87-47 a public hearing was called for June 3, 1987, at the hour of 7:00 P.M., in the Council Chambers in the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within those certain areas of the City of Baldwin Park, County of Los Angeles, State of California, generally described as follows: Underground Utility District No. 87-1 Please refer to Exhibit A WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; and WHEREAS, the City and the utilities affected hereby have agreed to pay 100% of the cost of conversion, including costs of users connections to underground facilities; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Baldwin Park, that pursuant to Chapter 13.08 of the City of Baldwin Park Municipal Code, the area described herein is hereby declared Underground Utility District, and is designated as Underground Utility District No. 87-1 of the City of Baldwin Park. Attached hereto and hereby incorporated as a part of this Resolution, is the map delineating the boundaries of said District; and RESOLVED, FURTHER, that the City Council does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 87-1 on or before January, 1989, RESOLVED, FURTHER, that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 87-1 of the adoption of this Resolution within ten 10) days after the date of such adoption. Said City Clerk shall further notify said property owners that they or such occupant shall, by the date fixed in this Resolution, be provided with all necessary facility changes on their premises at no cost to them so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public BIB] 37845-U01 1987-U02 051-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20513-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 051 CC RESO(Ìì÷EEstablish Underground Resolution No. 87 51 Utility District No. 87-1 Page Two Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution together with a copy of said Chapter 13.08 of the City of Baldwin Park Municipal Code to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; and RESOLVED/ FURTHER, that the City Council hereby finds and determines as follows: SECTION 1. The Underground District herein created is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid or eliminate an unusually heavy con- centration of overhead distribution facil- ities; 2. The streets, roads or rights of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic; 3. The said streets, roads or rights of way adjoin or pass through a civic area. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution.
