HomeMy WebLinkAbout1987 069B CC RESO1987 069B CC RESO(Ìì÷ RESOLUTION NO. 87-69B A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A MODIFICATION TO A CONDITIONAL USE PERMIT APPLICANT: CALDERON; LOCATION; 4105 MAIN AVENUE; CASE NO,: CP-287) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owners of certain real property located at 4105 Maine Avenue/ made application for a modification to an existing conditional use permit, Case No. CP-287, to allow dancing with live musicians conjunction with an existing cocktail lounge located on the site; and b) That the property to which said application relates is more particularly described in the file in Case No. CP-287 on file in the office of the Director of Planning of the City; and c) That the said modification was considered by the Planning Commission at a duly noticed public hearing the Commissions action was to deny the same; and d) That the timely appeal was filed appealing the decisions of the Commission to the City Council; and e) That the City Council conducted a duly noticed public hearing upon said appeal; that said appeal hearing before the City Council, the applicant requested that the approval of the modification be conditioned so that the same was valid only for a period of six months from and after the effective date of the Council's approval; that prior to the expiration of said six-month period of time, the matter would again be presented to the City Council at a duly noticed public hearing, to determine, based upon the experience of the utilization of the use during the six-month period, wheather the modification should be continued for an additional term; and f) That the City Council determined that the facts required for the granting of said application for modification were present and that the public interest requires the approval, subj ect to the conditions hereinafter set fourth, of the applicat- ion for such modification; and SECTION 2. That the above-described modification, so as to allow the customer dancing utilizing live musicians, in conjunction with the existing cocktail lounge be, and hereby is, granted, subject to the following terms and conditions: 1) That the duration of the approval of the modificat- ion granted by this Resolution shall be for a period of six months from and after the date of adoption of this resolution; and BIB] 37845-U01 1987-U02 069B-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20535-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 069B CC RESO(Ìì÷ 2) That during such time as the dancing is being conducted, private security guards shall be on the premises; the level and extent of such security services shall be approved by the Chief of Police of City; and 3) That all conditions of conditional use permit CP-287 approved in 1979 be complied with before dancing commences; and 4) That compliance with all other laws, regulations, and ordinances be strictly adheared to. SECTION 3. That the City Clerk shall certify the adoption of this Resolution and forward a copy hereof to the Secretary of the Planning Commission and to the applicant.
