A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK APPROVING AN
AMENDMENT TO THE LAND USE ELEMENT OF
THE GENERAL PLAN FOR APPROXIMATELY
3.0 ACRES OF PROPERTY LOCATED GENERALLY
WITHIN THE CITY OF LOS ANGELES WATER
AND POWER RIGHT-OF-WAY BETWEEN DALEWOOD
AVENUE AND WALNUT CREEK WASH
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find/ determine and declare, as follows:
a) That pursuant to the applicable provisions of the
Planning Law Section 65300 et seq. of the Govern-
ment Code of the State of California), studies were
commenced for the purpose of considering an amend-
ment to the Land Use Element of the City's General
Plan; and
b) That the Planning Commission has conducted a noticed
public hearing on the proposed amendment to the
said Land Use Element, Case No. AGP-76 as shown
on Exhibit C" and environmental analysis, as here-
inafter described; and
c) That the Planning Commission has recommended appro-
val of said environmental analysis, and proposed
amendment; and
d) That the City Council has conducted a noticed public
hearing on said matter and has determined that the
public interest requires the approval of Case No.
AGP-76 to amend the Land Use Element of the General
Plan by changing the land use designation from
Single Family Residential and Multiple Family
Residential to Open Space; and
e) That the amendment as proposed is consistent with
the purposes and intent of the General Plan and it
goals and objectives; and
f) That the proposed amendment, as above described, is
in the public interest and will promote the general
welfare.
g) That the conditional use permit application seeks
permission to allow a horticultural use; and
h) That the said matter was considered by the Planning
Commission, which body conditionally approved the
application; and
SECTION 2. That the City Council at the time of the public
hearing on the above matter reviewed and considered the proposed
Negative Declaration, and comments relating thereto. That the City
Council, based upon its public review, does hereby approve the pro-
posed Negative Declaration, since there is no substantial evidence
that the project will have a significant effect on the environment.
SECTION 3. That the amendment to the Land Use Element of
the City's General Plan as above described be, and hereby is, approved.

1987 073 CC RESO (Ìì ÷ ‘ SECTION 4. That the City Clerk shall certify to the
adoption of this Resolution and shall forward a certified copy thereof
to the Secretary of the Planning Commission and to the applicant.
