HomeMy WebLinkAbout1987 074 CC RESO1987 074 CC RESO(Ìì÷RESOLUTION NO. 87-74 A RESOLUTION OF THE CITY COUNCIL OF BALDWIN PARK GRANTING A CONDITIONAL USE PERMIT AND PARCEL MAP APPLICANT: ASCENSION EVANGELICAL LUTHERAN CHURCH/- LOCATION: 14855 PACIFIC AVENUE; CASE NO.: CP-25 AND PM-1114). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property, located at 14855 Pacific Avenue described as Parcels 63, 54, & 53 on Page 15 of Map Book 8438 as recorded by the Los Angeles County Assessor heretofore made applications for a modificiation of a Conditional Use Permit CP-25) and approval of a Parcel Map PM-1114) allowing a portion of an existing church property sold-off and combined with an adjacent property and a two-lot subdivision; and b) That the said matter was considered by the Planning Commission, which body denied the application; and c) That a timely appeal was taken, appealing the Plann- ing Commission's decision to the City Council; and d) That the City Council conducted a duly noticed public hearing upon the said matter and determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of a conditional use permit and approval of a parcel map were present, to wit: I. That the site is adequate in size and shape to accommodate the church use including all park- ing and two driveways; and II. That the site has sufficient access to Pacific Avenue; and III. That the use has not proven to have an adverse effect upon adjacent uses; and IV. That the use and Parcel Map is consistent with the General Plan and Zoning Ordinances. e) That based upon the above findings of fact, the applications should be granted subject to the conditions hereinafter set forth. SECTION 2. That the above described applications for a conditional use permit and parcel map be, and the same hereby is, granted subject to the following conditions: a) That the subject property shall remain developed substantially as shown on Exhibit A" dated July 8, 1987 including the restriping shown therein,' except as modified herein; and BIB] 37845-U01 1987-U02 074-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20530-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 074 CC RESO(Ìì÷ i b) That parking space No. 31 be deleted and replaced with a planter and the planter shown adj acent thereto be removed; and c) That a six 6) foot high block wall be installed along the northeasterly property line; and d) That wheelstops be installed within the parking lot to City standards; and e) That six 6) inch curbing be installed where land- scaping is adjacent to parking spaces and driveways/- and f) All conditions of the State Map Act and the City's Subdivision Ordinance must meet prior to recorda- tion; and g) All conditions of the Los Angeles County Fire Department must be met prior to recordation; and h) All special assessments and utilities or sewer connection fees are to be paid prior to recording the final map; and i) All requirements of the serving utilities are to be met or guaranteed prior to recording of the final map; and j) Submit a subdivision guarantee to this office; and k) The final map shall be based on a filed survey; and 1) All surveying for the proposed development will be done by the developer, including the establishment of centerline ties; and m) Enclose with the final map the surveyor's closure sheets; and n) A grading plan prepared by a Registered Civil Engineer must be submitted; and o) All improvement plans required for this development must be submitted with the final map before plan check will commence; and p) All improvement plans must be submitted in tripli- cate and q) Submit to this office a Geologic/Soils Report for Parcel 2 signed by a Registered Soils Engineer and drawn to the satisfaction of the City Engineer at time of development; and r) After the final map records, a sepia and two blue- prints shall be submitted to the Engineering Divis- ion at no cost to the City; and s) Approval of this tentative map does not constitute approval of a site plan or building footprints; and t) The final map must be recorded within 24 months or all proceedings shall be terminated; and BIB] 37845-U01 1987-U02 074-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20530-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 074 CC RESO(Ìì÷SECTION 3. SECTION 4. u) The conditions of approval for this parcel map may be appealed to the City Council by filing a written letter together with a filing and processing fee of $90.00 with the City Clerk within twenty 20) days from the date of this letter, That the City Council at the time of the public hearing on the above matter reviewed and considered the propose Negative Declaration and comments relating thereto. That the City Council based upon its public review, does here- by approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. That the City Clerk shall certify to the adoption of this Resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
