HomeMy WebLinkAbout1987 078 CC RESO1987 078 CC RESO(Ìì÷THE FOLLOWS: RESOLUTION 87-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A DEVELOPMENT PLAN APPLICANT: JOSEPH BATTAGLIA, INC; CASE NO.: Z-468 AND TM 45579). CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS SECTION 1. That the City Council does hereby find/ determine as follows: of the City of Baldwin Park a) That the owners of certain real property located at 13176 Francisquito Avenue, heretofore filed an an application for an approval of a Development Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a ten unit single family residential planned development; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recom- mended that the same be approved, subj ect to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, de- termined that the said application should be granted, subj ect to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the follow- ing Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the purpose and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated September 2, 1987 with the following modi- fications: BIB] 37845-U01 1987-U02 078-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20526-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 078 CC RESO(Ìì÷I. That one 1) additional outdoor light shall be installed and located in the area adjacent to the common open space area as discussed in Staff's report; and II. That the proposed wall along the north property line within the required front yard area shall be reduced to three 3) feet in height; and b) The CC&R's shall reflect that the homeowner's association shall maintain all common areas and the landscaping of the front of each unit outside of the walled yard, the maintenance of the walls located on a property line, and that future unit expansions shall be limited to patio covers only, which shall not exceed 25 percent of the lot's private open space; a three 3) foot side yard area, except that an existing zero 0) side yard area building line may be continued, and a five 5) foot rear yard area building line may be continued, and a five 5) foot rear yard area shall be maintained for said units; and c) That the CC&R's shall note that the private street lane, and No Parking" signs shall be posted and maintained for said street; and d) That the CC&R shall include the City's resolution of approval as an addendum; and e) That electric garage door openers be provided for each unit; and f) The applicant shall enter into an agreement for in- dividual onsite pick-up with the refuse company; and g) That the applicant shall submit to the Planning Division three 3) sets of landscape and irrigation plans, a street light design and CC&R's for review and approval; and h) That construction shall commence within one 1) year of the effective date of City Council approval, or approval of the development plan is null and void; and i) All conditions of the State Map Act and the City's Subdivision Ordinance must be met prior to recorda- tion; and j) All conditions of the Los Angeles County Fire De- partment must be met prior to recordation; and k) All special assessments and utilities or sewer connection fees are to be paid prior to recording the final map; and 1) All requirements of the serving utilities are to be met or guaranteed prior to recording of the final map; and m) The applicant shall submit a Subdivision Guarantee to this office; and n) The final map shall be based on a filed survey; and BIB] 37845-U01 1987-U02 078-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20526-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 078 CC RESO(Ìì÷o) All surveying for the proposed development will be done by the developer, including the establishment of centerline ties; and p) Enclosed with the final map the surveyor's closure sheets; and n) A Grading Plan prepared by a Registered Civil Engin- eer must be submitted; and r) All improvement plans required for this development must be submitted with the final map before plan check will commence; and s) All improvement plans must be submitted in tripli- cate; and t) Submit to this office a Geologic/Soils Report signed by a Soils Engineer and drawn to the satis- faction of the City Engineer; a foundation investi- gation only will be required if no deviations from UBC are proposed with the design of the new resi- dential units; and u) Sewer plans, signed by a Registered Civil Engineer and designed and drawn to the satisfaction of the City Engineer, must be submitted if an on-site mainline facility is proposed; and v) The following off-site improvements must be existing or guaranteed for: I. Remove existing drive approach and replace with full curb and sidewalk; and II. Construct one 1) modifed concrete drive approach with wheelchair ramp; and III. One 1) street tree; and IV. Sewer mainline; and V. Sewer laterals; and w) After the final map records, a sepia and two blue- line prints shall be submitted to the Engineering Division at no cost to the City, final occupancy will not be granted until the recorded map is received by the Engineering Division; and x) Ten 10) foot of easement for on-site sewer trunk, 8" minimum, shall be dedicated on final map and sewer plan or by separate instrument if an onsite mainline facility is proposed; and y) The City has recently awarded a Cable TV Franchise to United Cable Television of Baldwin Park, Inc. you may wish to consider prewiring and otherwise making ready for future cable connection all re- sidential units constructed on this property; and z) Approval of this tentative map does not constitute approval of a site plan or building footprints; and BIB] 37845-U01 1987-U02 078-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20526-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 078 CC RESO(Ìì÷aa. Draft CC&R's will be reviewed and approved by the City Attorney prior to approval of the Tract Map; and bb. Draft CC&R's will be reviewed and approved by the City Attorney prior to approval of the Tract Map; and cc. The final map must be recorded within 24 months or all proceedings shall be terminated; and dd. That the applicant shall sign a notarized affidavit within twenty 20) days after the adoption of the resolution that the applicant has read and accepts all the conditions of approval. SECTION 4, That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact/ and in reaching the conclusion that the De- velopment Plan should be conditionally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution/ and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the manner pre- cribed by law. PASSED AND APPROVED ON September 2 1987.
