HomeMy WebLinkAbout1987 079 CC RESO1987 079 CC RESO(Ìì÷}RESOLUTION NO. 87-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A DEVELOPMENT PLAN ALLOWING A SEVEN UNIT SINGLE FAMILY DEVELOPMENT APPLICANT: MING-NANG CHEN; CASE NO.: 2-470). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine as follows: a) That the owners of certain real property located at 4765 Stewart Avenue/ heretofore filed an applica- tion for an approval of a Development Plan/ pursuant to Chapter 17.30 of the Baldwin Park Municipal Code/ to allow the construction of a seven unit single family planned development; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recomm- mended that the same be appproved/ subj ect to certain conditions; and d) That the City Council conducted a duly notice public hearing upon said matter/ and based upon the evidence presented and each member of the Council being familiar with the Property/ de- termined that the said application should be granted/ subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical develop- ment of the land; and d) That the proposed development meets the purpose and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted/ subject to the following conditions: a) That subject property shall be developed and main- tained in substantial compliance with Exhibit A" dated September 2, 1987; and BIB] 37845-U01 1987-U02 079-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20525-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 079 CC RESO(Ìì÷}The CC&R's shall reflect that the homeowner's association shall maintain all common areas and the landscaping of the front of each unit outside of the walled yard, the maintenance of the walls located on a property line, and that future unit expansions shall be limited to patio covers only, which shall not exceed 25 percent of the lots private open space; a five 5) foot side yard area, and a five 5) foot rear yard area shall be maintained for said units; and That the CC&R's shall note that the private street is a fire lane/ and No Parking" signs shall be posted and maintained for said street; and That the CC&R's shall include the City's resolution of approval as an addendum; and That design approval is subject to this project meeting all design requirments of the Los Angeles County Fire Department; and The applicant shall enter into an agreement for in- dividual onsite pick-up with the refuse company; and That electric garage door openers shall be provided for each unit; and That 24 inch box specimen trees shall be provided in front of each unit, at the entrances to the project and within the common open space area; and On-site private street shall be designed as a public" street" section with a crown along the centerline and an integral curb and gutter; and That the applicant shall submit to the Planning Division, landscape, irrigation plans, and CC&R's for review and approval; and That construction shall commence within one 1) year of the effective date of City Council approval, or approval of the development plan and zone variance is null and void; and The applicants shall install all public improvements as required by the Engineering Division and Fire De- partment and That the applicant shall submit for approval a tentative map with CC&R's said map shall show a com- mon lot which shall include the private street and all common open space areas; and That the applicant shall submit for approval a grad- ing plan, a street plan, soils report and a sewer plan pursuant to City standards; and That the applicant shall sign a notarized affidavit within twenty 20) days after the adoption of the resolution that the applicant has read and accepts all the conditions of approval; and BIB] 37845-U01 1987-U02 079-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20525-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 079 CC RESO(Ìì÷}SECTION 4. That the City Council relied upon the Adminis- trative Record, and the evidence presented at the public hearing in reaching the conclusion that the Development Plan should be condition- ally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adop- tion of this resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file the Negative Declaration in the manner prescribed by law. PASSED AND APPROVED ON September 2 1987. s^^ e^?^ MAYOR ATTEST: INDA L.
