HomeMy WebLinkAbout1989 099 CC RESO1989 099 CC RESO(Ìì½¼RESO 89-99 DEC 20 1989H"í8 RESOLUTION NO. 89-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN AND TENTATIVE TRACT MAP APPLICANT: SAN PALO DEVELOPMENT CORP.; CASE NO. Z-493 & PM-1201; LOCATION: LOT 6 OF PARCEL MAP 1142 ON BROOKS DRIVE, BALDWIN PARK, CALIFORNIA). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owners of certain real property approximately 4.02 acres in area located on the northeast end of Brooks Drive, heretofore filed an application for an approval of a Development Plan hereinafter Plan") and Tentative Parcel Map herein after Map") pursuant to Chapters 17.30 and 16.01 respectively of the Baldwin Park Municipal Code, to allow the construction of a four industrial building concept planned development and approval of a five lot tentative parcel map; and b) That the real property hereinafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recommended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development, containing four 4) concrete tilt-up buildings, has adequate parking and accessibility and is consistent with the policies of the General Plan; and b) That the proposed change of zone is compatible with and will not be detrimental to surrounding properties; and c) That the proposed zoning would allow a logical and rational development plan for an industrial park; and d) That the proposed Industrial Planned Development Overlay Zone I(PD), which maintains the standards and permitted uses of the underlying Industrial Zone, is consistent with the General Plan. That the above described Plan be, and the same hereby is granted, subject to the following conditions: a) The the subject property shall be developed and maintained substantially in accordance with Exhibit A" dated December 13, 1989; and b) That the applicant shall submit a uniform sign program subject to the review and approval of the Planning Division during the Plan check phase of this project, and that all signage requires a separate permit and is subject to review and approval by the Planning Division; and c) The CC&R'S shall reflect that the owners association shall maintain all areas except buildings i. e. all landscaping, and parking lots trash and debris clean-up); and d) That CC&R'S shall include the City's resolution of approval as an addendum; and e) That the CC&R'S for this subdivision shall be submitted to the Engineering Division for approval; and f) That the applicant shall submit a landscape and irrigation plan, lighting plan for approval to the Planning Division during the plan check phase of this project; and g) That no outside storage is permitted; and h) That reciprocal emergency vehicles ingress and egress to all parcels be maintained at all times; and i) That the applicant must comply with the Baldwin Park Municipal code and other applicable laws; and j) That the applicant shall sign a notarized affidavit within twenty 20) days after the adoption of the City Council resolution that the applicant laws has read and accepts all the conditions of approval. SECTION 4. That the above described Map, and the same hereby is granted, subject to the following conditions: a) All conditions of the State flap Act and the City's Subdivision ordinance must be met prior to map recordation. b) All conditions of the Los Angeles County Fire Department must be met prior to map recordation. c) All requirements of the serving utilities are to be met or guaranteed for prior to recording of the final map. d) The final map shall be based on a field survey. e) All surveying for the proposed development will be done by the applicant including the establishment of centerline ties. BIB] 37650-U01 1989-U02 099-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO2229-U03 DO2233-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 89-99-U05 DEC-U05 20-U05 1989-U05 1989 099 CC RESO(Ìì½¼RESO 89-99 DEC 20 1989H"í8Resolution No. 89-99 Page 3 of 4 f) Each building must have a separate and independent connection to a mainline sewer. g) Submit a subdivision guarantee and the surveyor's closure sheets for approval with the final map. h) All improvement plans must be submitted for approval with the final map before plan check will commence. i) All improvement plans must be submitted in triplicate. j) The following improvement plans prepared by a Registered Civil Engineer will be required to be submitted for approval. i) Sewer plan if an on-site mainline is proposed) and ii) Grading Plan k) A geological/soils report prepared by a registered Soils Engineer must be submitted with the grading plan. 1) The following off-site improvements must be existing or guaranteed: i) Removal of any existing depressed curb not to utilized and replaced with full height curb; and ii) Concrete drive approach. m) Relocation of existing street lights or irrigation system within the public right of way due to construction will be at the developer's expense. n) on-site access and circulation must be approved by the Los Angeles County Fire Department. o) Prior to City approval of the Grading Plan, the Engineering Division must receive written verification from the Department of Water and Power DWP) for work within their easement. p) After the final map records, a sepia and two blueline prints shall be submitted to the Engineering Division at no cost to the City. Final occupancy will not be granted until the recorded map is received by the Engineering Division. SECTION 5. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Plan and Map should be conditionally approved. SECTION 6. That the city Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA Guidelines, and the city's procedures. That the City Clerk shall certify to the adoption of this resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file the Negative Declaration in the manner prescribed by law. PASSED AND APPROVED ON DECEMBER 20, 1989.
