HomeMy WebLinkAbout1990 020 CC RESO1990 020 CC RESO(Ìì¾h RESOLUTION 90-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE GENERAL PLAN CASE NO: AGP-88 Parts 1, 2, AND 3; APPLICANTS: WILLIAMS; NOTTINGHAM; CITY OF BALDWIN PARK). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That pursuant to the * applicable law including provisions of the Planning Law Section 65300 et seq. of the Government Code of the State of California), studies were commenced for the purpose of considering the need for an amendment to the Circulation and Land Use Elements of the City's General Plan; and b) That the Planning Commission has conducted a noticed public hearing on the proposed amendment to the said Elements Case No. AGP-88 Parts 1, 2, and 3; Williams; Nottingham; City of Baldwin Park) as shown on Exhibits B" and F" on file in the Planning Division of the City, and an environmental analysis, as hereinafter described; and c) That the Planning Commission has recommended approval of said environmental analysis and proposed amendment; and d) That the City Council has conducted a noticed public hearing on said matter and has determined that the public interest requires the approval of Case No. AGP-88 Parts 1, 2, and 3; Williams; Nottingham; City) to amend the Land Use Element and Circulation Element of the General Plan, as is shown on Exhibits B" and F" on file in the Planning Division; which amendment would delete the future street which connects Merced Avenue and the existing terminus within the 3600 Block of Paddy Lane, with the existing terminus extended to form a cul-de-sac; to delete the future street which forms a T" within the block bounded by Maine Avenue to the West, Phelan Avenue to the East Olive Street to the North, and Cavette Place, which connects, to the South; and to delete approximately 360 feet of the future extension of Stichman Avenue to Merced Avenue; and the amendment to the Land Use Element as shown on said exhibits; Amendment"); and e) That the Amendment as proposed is consistent with the purposes and intent of the General Plan and its goals and objectives; and f) That the Amendment is required and is in the public interest and will promote the general welfare. SECTION 2. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Mitigated Negative Declaration, relating to the Amendment AGP-88; parts 1, 2, and 3). That the City Council based upon its public review, recommended approval of the proposed Mitigated Negative Declaration, since the impacts identified will be mitigated to a level of insignificance. SECTION 3. That the Amendment to the City's General Plan, be, and hereby is, approved. That the City Council shall certify to the adoption of this resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and the applicant.
