HomeMy WebLinkAbout1990 066 CC RESO1990 066 CC RESO(Ìì¾RESO 90-66 AUG 15 1990H/›8 RESOLUTION NO.90-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A SPECIFIC PLAN ON APPROXIMATELY 26.1 ACRES OF LAND TO ENSURE THE COORDINATED DEVELOPMENT OF THAT PORTION OF THE HOME SAVINGS OF AMERICA CAMPUS LOCATED WITHIN THE CITY OF BALDWIN PARK APPLICANT: HOME SAVINGS OF AMERICA; CASE NO. SP 90-1; LOCATION: 5000 BLOCK OF COMMERCE DRIVE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That Home Savings of America Applicant") heretofore filed an application Application") for an approval of a specific plan in Case No. SP 90-1 Plan") pursuant to Section 65450 et seq. of the Government Code to ensure the coordinated development for office or industrial and purposes on certain real property located within the 5000 block of Commerce Drive described, more particularly in the Application which is on file in the office of the Secretary of the Planning Commission of the City Property"), and environmental analysis; and b) That the Planning Commission conducted a duly noticed public hearing to consider adoption of said Plan and recommended that the same be approved; and c) That the Plan as proposed is consistent with the purpose and intent of the San Gabriel River Redevelopment Project Area Plan and the General Plan and their goals and policies; and d) That the City Council conducted a duly noticed public hearing to consider adoption of said Plan and determined that the public interest requires approval of said Plan; and SECTION 2. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in reaching the conclusion that the Plan should be approved. SECTION 3. That the Specific Plan, be on file in the Office of the City Planner, marked Specific Plan SP 90-1", and the same hereby is, adopted and shall be operative as of the date of the adoption of this Resolution. The original of the Specific Plan is on file with the City Clerk. SECTION 4. That the owner or owners of Property shall pay a Specific Plan Fee in the amount of $2,500.00 prior to the issuance of any permits or other entitlements permitting the construction of buildings or structures upon the Property. SECTION 5. That the City Council finds the Mitigated Negative Declaration for this project has been prepared and considered pursuant to, and in accordance with the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. The Mitigated Negative Declaration is approved and ordered filed. That the City Planner shall note the existence of the Plan on the City's Official Zoning Map as adopted pursuant to Section 17.06.020 of the Baldwin Park Zoning Code. SECTION 7. That the City Planner shall be responsible for the implementation and enforcement of the provisions of the Plan. SECTION 8. That the City Clerk shall certify to the adoption of this Resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission.
