HomeMy WebLinkAbout1990 087 CC RESO1990 087 CC RESO(Ì쾚RESO 90-87 NOV 7 1990@˜Ä8 RESOLUTION NO. 90- 87 A RESOLUTION OF TEE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING TEE SALE OF CERTAIN CITY-OWNED REAL PROPERTY TO BE FOR THE COMMON GOOD AND THE BENEFIT OF THE CITY; DECLARING SAID REAL PROPERTY TO BE SURPLUS; AND OFFERING TEE SENDING OF WRITTEN OFFERS TO SELL THE PROPERTY WHEREAS, pursuant to Government Code Sections 37350 and 37351, a city may dispose of and convey real property for the common good and for the benefit of the city; WHEREAS, pursuant to Government Code Sections 54220 et seq., real property owned by a city which is no longer necessary for the city's use may be declared surplus; WHEREAS, THE City owns certain real property located on the northeast side of Merced Avenue, approximately 348 feet southeasterly from Vineland Avenue, in the City of Baldwin Park, California, more particularly described as that portion of Lot 54, El Monte walnut Place, as shown on the map filed in Book 6, Page 104 of Maps, in the Office of the County Recorder, County of Los Angeles, California, the legal description of which is attached hereto as Exhibit A" the Subject Parcel"); WHEREAS, the Subject Parcel was originally acquired by the City as a site for the potential development of low and moderate income housing; WHEREAS, the Subject Parcel is no longer needed for the development of low and moderate income housing in that it is too small for the efficient and economically feasible development of an affordable housing project, and the City has insufficient funds to develop, promote, or otherwise subsidize such a project; WHEREAS, the sale of the Subject Parcel would redound to the common good and benefit of the City in that it would render more likely development of the site in a use beneficial to the community; WHEREAS, the location, purpose and extent of such disposition is in conformity with the adopted General Plan of the City of Baldwin Park; WHEREAS, disposition of the Subject Parcel is categorically exempt from the provisions of the California Environmental Quality Act under state CEQA Guidelines 14 California Code of Regulations Section 15312). NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby resolve as follows: SECTION 1. The above recitals are all true and correct. SECTION 2. Sale and disposition of the Subject Parcel would be for the common good of the people of the City of Baldwin Park and would benefit the City of Baldwin Park. SECTION 3. The Subject Parcel is no longer necessary for the City's use and is hereby declared to be surplus. City staff shall forthwith send those written offers to sell the Subject Parcel as required by Article 8 of Chapter 5 of Division 2 of Title 5 of the Government Code, commencing with Section 54220.
