HomeMy WebLinkAbout1991 036 CC RESO1991 036 CC RESO(Ìì¼> RESOLUTION NO. 91-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A SPECIFIC PLAN ON APPROXIMATELY 3.6 ACRES OF LAND TO ENSURE THE COORDINATED DEVELOPMENT OF THE SITE FOR COMMERCIAL PURPOSES APPLICANT: CITY OF BALDWIN PARK; CASE NO: SP 91-1; LOCATION: 3111-3163 N. BALDWIN PARK BOULEVARD AND 13537-13543 E. TRACY STREET). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the City of Baldwin Park Applicant") heretofore filed an application Application") requesting approval of a specific plan in Case No. SP 91-1 Plan") pursuant to Section 65450 et seq. of the Government Code to ensure the coordinated development for commercial purposes on certain real property located at 3111- 3163 N. Baldwin Park Boulevard and 13537-13543 E. Tracy Street, described more particularly in the application which is on file in the office of the Secretary of the Planning Commission of the City Property"), and environmental analysis, Case No. SP 91-1; and b) That the Planning Commission held a duly noticed public hearing on the proposed Plan, and has recommended approval of the said environmental analysis and approval of the proposed Plan; and c) That the Plan as proposed is consistent with the purpose and intent of the Sierra Vista Redevelopment Project Area Plan and the General Plan, and their goals and objectives; and d) That the City Council has conducted a noticed public hearing on said matter, and based upon the evidence presented has determined that the Specific Plan should be approved; and e) That the proposed Specific Plan, as above described, is in the public interest and will promote the general welfare. SECTION 2. That the City Council relied upon the Administrative Record, and evidence presented at the public hearing, in reaching the conclusion that the Plan should be approved. SECTION 3. That the Specific Plan, on file in the Office of the City Planner, marked Specific Plan SP 91-1", be and the sane hereby is, adopted and shall be operative as of the date of the adoption of this resolution. The original of the Specific Plan is on file with the City Clerk. SECTION 4. SECTION 5. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration. That the City Council based upon its public review, does hereby approve, adopt, and order filed the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 6. That in conjunction with the Negative Declaration, the City Council considered and does hereby approve, adopt and file the California Department of Fish and Game, Certificate of Fee Exemption for De Minimis Impact Finding, as the environmental analysis offers no substantial evidence that the proposed Plan will have potential for an adverse effect, either individually or cumulatively, on wildlife resources, as defined in Section 711.2 of the Fish and Game Code. SECTION 7. That the City Planner shall note the existence of the Plan on the City's Official Zoning Map as adopted pursuant to Section 17.06.020 of the Baldwin Park Zoning Code. SECTION 8. That the City Planner shall be responsible for the implementation and enforcement of the provisions of the Plan. SECTION 9. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission. The Secretary of the Planning Commission, on behalf of the City Clerk, shall file the Negative Declaration and Certificate of Fee Exemption. APPROVED AND ADOPTED THIS 3rd DAY OF July 1991.
