HomeMy WebLinkAbout1991 037 CC RESO1991 037 CC RESO(Ìì¼; RESOLUTION NO. 91-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING DESIGN REVIEW GUIDELINES APPLICABLE TO ALL NEW COMMERCIAL AND INDUSTRIAL DEVELOPMENT PROJECTS LOCATED WITHIN THE BOUNDARIES OF THE SIERRA VISTA REDEVELOPMENT PROJECT AREA APPLICANT: CITY OF BALDWIN PARK; CASE NO.: DRG 91-1). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the City of Baldwin Park Applicant") heretofore filed an application Application") requesting approval of Design Review Guidelines Guidelines") applicable to all commercial and industrial properties located within the boundaries of the Sierra Vista Redevelopment Project Area, described more particularly in the application which is on file in the office of the Secretary of the Planning Commission of the City Property"), and environmental analysis, Case No. DRO 91-1; and b) That the Planning Commission held a duly noticed public hearing on the proposed Guidelines, and has recommended approval of the said environmental analysis and adoption of the proposed Guidelines; and c) That the City Council has conducted a noticed public hearing on said matter, and based upon the evidence presented has determined that the Guidelines should be adopted; and d) That the Guidelines as proposed are consistent with the purpose and intent of the Sierra Vista Redevelopment Project Area Plan and the General Plan, and their goals and objectives; and e) That the proposed Guidelines, as above described, are in the public interest and will promote the general welfare. SECTION 2. That the Guidelines, Case No. DRO 91-1, are hereby approved and adopted. SECTION 3. That the City Council relied upon the Administrative Record, and evidence presented at the public hearing, in reaching the conclusion that the Guidelines should be approved. SECTION 4. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration. That the City Council based upon its public review, does hereby approve, adopt, and order filed the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant impact on the environment. That in conjunction with the Negative Declaration, the City Council considered and does hereby approve, adopt and file the California Department of Fish and Game, Certificate of Fee Exemption for De Minimis Impact Finding, as the environmental analysis offers no substantial evidence that the proposed Guidelines will have potential for an adverse effect, either individually or cumulatively, on wildlife resources, as defined in Section 711.2 of the Fish and Game Code. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission. The Secretary of the Planning Commission, on behalf of the City Clerk, shall file the Negative Declaration and Certificate of Fee Exemption. APPROVED AND ADOPTED this day of July 3, 1991.
