A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK OFFERING A
REWARD UNDER THE GRAFITTI OFFENDER
REWARD PROGRAM
WHEREAS, California Government Code Section 53069.5
authorizes cities to offer and pay a reward for information
leading to the determination of the identity of, and the
apprehension of, any person who willfully damages property; and
WHEREAS, Section 9.20.050 of the Baldwin Park Municipal Code
provides that a reward amount for the receipt of information that
leads to the determination of the identity of, apprehension of,
and conviction of any person willfully defacing public or private
property will be established by resolution.
NOW, THEREFORE, the City Council of the City of Baldwin Park
resolves as follows:
SECTION 1: Pursuant to Section 53069.5 of the Government
Code, the City of Baldwin Park offers a reward of up to One
Thousand Dollars $1,000.00) for information leading to the
determination of the identity of, apprehension of, and conviction
of any person who willfully paints, mars, or defaces any public
or private structure in violation of City Code Chapter 9.20 and
state law.
SECTION 2: The offer of reward is made to members of the
public generally, but is not made to any law enforcement officer,
municipal officer, official, officer or employee or agent of the
State or any county or city therein, or any political subdivision
thereof.
SECTION 3: Any claim for reward must be made to the City
Council of the City of Baldwin Park. In no event will the amount
of a reward, nor sum of rewards in connection with a single
incident exceed the combined total sum of One Thousand Dollars
$1,000.00). In event of any dispute, including whether a
claimant or claimants for the reward produced information leading
to the determination of the identification, apprehension and
conviction of any person or persons who willfully painted, marred
or defaced any public or private property in the City of Baldwin
Park in violation of City Code Section Chapter 9.20 or state law,
or the sharing of the reward or rewards among claimants, the
determinations of the City Council shall be final and
conclusive.
SECTION 4: Pursuant to Government Code Section 53069.5, any
person convicted for violation of the City of Baldwin Park Code
Chapter 9.20 or state law, or the parent or guardian of any
unemancipated minor convicted for violation of said law, shall be
required to pay restitution to the City for any reward paid by
the City pursuant to this resolution.
SECTION 5: This offer or reward shall remain open until its
revocation by the City Council, provided revocation occurs prior
to acceptance.
SECTION 6: The City Clerk shall certify to the passage of
this resolution by the City Council of the City of Baldwin Park,
and it shall thereupon take effect.
