HomeMy WebLinkAbout1991 086 CC RESO1991 086 CC RESO(Ìì»ñ RESOLUTION NO. 91-86 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING A REQUEST FOR APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW THE OFF-SITE SALE OF BEER AND WINE IN CONJUNCTION WITH A MINI-MARKET. APPLICANT: ROBERT AND GUADALUPE BOBADILLA; LOCATION: 3634 BALDWIN PARK BOULEVARD; CASE NO.: CP-507). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That an application Application") for a conditional use permit Permit") was submitted on behalf of the owner of certain real property, located at 3634 Baldwin Park Boulevard, in the City of Baldwin Park, described more particularly in the Application on file with the City Planner Planner"); and b) That the Application was sought to allow the off-site sale of beer and wine in conjunction with a mini-market Section 17.18.030.A of the City Code); and c) That the Planning Commission, on September 25, 1991 conducted a duly noticed public hearing on said appeal and, based upon the evidence presented including applicable staff reports and each member of the Commission being familiar with the Property, denied the Application; and d) That the Appellant filed a timely appeal from the decision of the Planning Commission with reference to the conditional use permit; and e) That the City Council conducted a duly noticed public hearing upon said matter and determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of a conditional use permit were not present, to wit: 1) That the developed portion of the 22 acre site is not adequate in size and shape to accommodate the proposed use; and 2) That the site has sufficient access to streets adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use, as the subject property has access to Baldwin Park Boulevard; and 3) That the proposed use may have an adverse effect upon uses adjacent to the subject property because necessary measures such as adequate lighting, security alarm system, interior and exterior surveillance cameras, block walls adjacent to the residentially zoned properties, and paving) have not been provided to help protect the adjacent residences and deter potential problems; and BIB] 37650-U01 1991-U02 086-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO2009-U03 DO2029-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 91-86-U05 NOV-U05 6-U05 1991-U05 1991 086 CC RESO(Ìì»ñ Resolution No.91-86 Page 2 of 2 4) That the proposed use is inconsistent with Goal #1.1 of the General Plan Public Services and Facilities Element because the proposed use does not contain any protective measures as described in finding #3) to alleviate or help reduce the opportunities for crimes on persons and property. SECTION 2. That the conditional use permit application, as hereinabove described, be and the same hereby is denied. SECTION 3. That the City Council relied upon the evidence presented at the public hearing in making the above findings of facts, and in reaching the conclusion that the conditional use permit should be denied. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution and shall forward a copy hereof to the Secretary of the Planning Commission and to the Applicant.
