HomeMy WebLinkAbout1991 093 CC RESO1991 093 CC RESO(Ìì¼ì RESOLUTION NO. 91-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT 91-2 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AS FOLLOWS: WHEREAS, by Resolution No. 91-64 a public hearing was called for November 20, 1991, at the hour of 7:00 P.M., in the Council Chambers in the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within those certain areas of the City of Baldwin Park, county of Los Angeles, State of California, generally described as Underground Utility District No. 91-2 located generally along Downing Avenue between Ramona Boulevard and Pacific Avenue; and WHEREAS, District 91-2 is a rule 20 B Project; and WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Baldwin Park, that pursuant to chapter 13.08 of the City of Baldwin Park Municipal Code, the area described herein is hereby declared Underground Utility District, and is designated as Underground Utility District No. 91-2 of the City of Baldwin Park. Attached hereto and hereby incorporated as a part of this Resolution, is the map marked Exhibit A" delineating the boundaries of said District; and RESOLVED, FURTHER, that the City Council does hereby set October 30, 1992 as the date in which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within underground Utility District No. 91-2 on or before eighteen 18) months from the date of adoption of this Resolution; and RESOLVED, FURTHER, that the City clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 91-2 of the adoption of this Resolution within ten 10) days after the date of such adoption; and BIB] 37650-U01 1991-U02 093-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO2009-U03 DO2022-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 91-93-U05 NOV-U05 20-U05 1991-U05 1991 093 CC RESO(Ìì¼ì Establish Underground Resolution No. 91-93 Utility District No. 91-2 Page Two of Three Said City Clerk shall further notify, if necessary, said property owners that if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the suppling utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution together with a copy of said Chapter 13.08 of the City of Baldwin Park Municipal Code to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. In the event the City decides to fund the installation of the facilities, the property owners are required to allow the City's contractor access to their property; and RESOLVED, FURTHER, that the City Council hereby finds and determines as follows: SECTION 1. The Underground District herein created is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid or eliminate an unusually heavy con- centration of overhead distribution facil- ities; and 2. The streets, roads or rights of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic; and 3. The said streets, roads or rights of way adjoin or pass through a civic area; and 4. That the City of Baldwin Park pay as part of the underground utility project to extend the private service laterals for a distance up to 100'. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED on November 20, 1991.
