HomeMy WebLinkAbout1992 017 CC RESO1992 017 CC RESO(Ìì³6 RESOLUTION NO. 92-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE VACATION OF' A STREET EASEMENT ADJACENT TO 88 PLAZA SHOPPING CENTER 92-V-1) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That in accordance with the provisions of Public Street Highways and Service Easements Vacation Law" Section 8300 et. seq. Streets and Highways Code) the City Council of Baldwin Park adopted a Resolution declaring its intention to vacate a certain portion of a public street, to wit: a street easement of old Ramona Boulevard between La Rica Avenue and N. Baldwin Park Boulevard in the City of Baldwin Park, County of Los Angeles, State of California, as is more described herein; and b) That said Resolution and the Notice of Vacation were duly posted, all in the form, place, time and manner required by law and all legal requirements have been met; and c) That the City Council, conducted the hearing required by said Resolution of Intention and heard all evidence offered in relation to the proposed vacation, and considered the effect thereof on the City's General Plan; and d) That the provisions of Government Code Section 65402 a) do not apply to this vacation as the disposition of this property constitutes the disposition of the remainder of a larger parcel which was acquired and used in part for street purposes and alignment purposes, and is of a minor nature. e) That the portion of the public street proposed for vacation hereunder is described in Exhibit B"; and f) That based upon the evidence, it is found hereby that said STREET AREA is not now needed for future or present public purposes; nor, is the same useful as a non-motorized transportation facility; and g) That the STREET AREA proposed for vacation is illustrated on Exhibit A", attached hereto, and incorporated herein by this reference; and h) That from and after the date of recordation of this Resolution, the above-described STREET AREA shall no longer constitute a public street. That based, upon the foregoing, the said STREET AREA, be and hereby is, ordered vacated, as an existing public street, provided that all of the easements and rights as described in Section 8340 a) of the Streets and Highways Code, to which reference is hereby made, are excepted and reserved. SECTION 3. That, the City Clerk is hereby directed to certify to the passage of this Resolution and shall cause a certified copy thereof, to be recorded in the Office of the County Recorder, Los Angeles County, State of California.
