A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK
APPROVING A MITIGATED NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT
FOR THE CITY OF BALDWIN PARK'S
PROPOSED COMMUTER RAIL STATION
APPLICANT: CITY OF BALDWIN PARK;
LOCATION: 3875 N. DOWNING AVENUE.)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine and declare as follows:
a) That a Mitigated Negative Declaration for a
proposed Commuter Rail Station, located at 3875 N. Downing
Avenue, in the City of Baldwin Park, County of Los
Angeles, described more particularly in the records on
file with the City Planner hereinafter Property") was
submitted by the City of Baldwin Park for the City
Council's consideration; and
b) That a duly noticed public hearing was held on
said Mitigated Negative Declaration by the City Council on
March 18, 1992; and
c) That based upon the evidence presented
including the Initial Study, applicable staff reports and
each member of the City Council being familiar with the
Property, it was determined that the Mitigated Negative
Declaration should be granted.
SECTION 2. That the City Council does hereby adopt the
following Findings of Fact:
a) That the Baldwin Park Commuter Rail Station
located on said Property, will be constructed on a 3.3
acre strip of land that will be developed with a canopy
shelter covering a raised 12' by 425' plus or minus)
boarding platform, a parking lot for approximately 300
cars, landscaping, and lighting, and that the project will
also include the construction of two traffic signals at
the intersections of Ramona Blvd./Downing Ave., and
Pacific Ave./Downing Ave., the undergrounding of existing
overhead utility lines and the incorporation of public art
into the site; and
b) That an Initial Study has been conducted by the
Lead Agency City of Baldwin Park) so as to evaluate the
potential of adverse environmental impact; and
c) That the proposed project will not have a
significant impact on the environment, because the
potential impacts identified will be mitigated to a level
of insignificance; and
d) That there is no evidence before the Lead
Agency that the proposed project will have potential for
an adverse effect on wildlife resources or the habitat
upon which the wildlife depends; and

e) That the Lead Agency has, on the basis of
substantial evidence rebuts the presumption of adverse
effect on fish and wildlife resources or the habitat upon
which the wildlife depends.
SECTION 3. That the City Council finds the Mitigated
Negative Declaration for this project has been prepared and considered
pursuant to, and in accordance with the provisions of CEQA and the State
CEQA Guidelines. The Mitigated Negative Declaration is ordered approved
and filed.
SECTION 4. That the City Council relied upon the
Administrative Record, and the evidence presented at the public hearing
in making the above Findings of Fact, and in reaching the conclusion
that the Mitigated Negative Declaration should be approved.
SECTION 5. That the City Clerk shall certify to the
adoption of this Resolution and forward a copy hereof to the Secretary
of the Planning Commission.
