HomeMy WebLinkAbout1992 025 CC RESO1992 025 CC RESO(Ìì³  RESOLUTION NO. 92-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONE VARIANCE TO ALLOW THE CONSTRUCTION OF A SECOND DWELLING UNIT ON A LOT WHICH CONTAINS LESS THAN THE MINIMUM REQUIRED 10,000 SQUARE FEET IN AREA APPLICANT: JOSE AND IRENE RAMIREZ; LOCATION: 3434 MANGUM STREET, BALDWIN PARK, CALIFORNIA 91706; CASE NO.: ZV-596). WHEREAS, the owner Applicant") of certain real property located at 3434 Mangum Street, more particularly described in the said application Application") which is on file in the office of the Secretary of the Planning Commission of the City hereinafter Property") made application for a zone variance, as hereinafter described; and WHEREAS, the Application seeks permission to allow the construction of a second dwelling unit on a lot which contains less than the minimum required 10,000 square feet in area Section 17.10.020.A.3 of the City Code); and WHEREAS, the Planning Commission, on January 22, 1992, conducted a duly noticed public hearing on said Application, and voted to deny the Application; and WHEREAS, Applicant filed a timely appeal of the Planning Commission's decision to the City Council; and WHEREAS, a duly noticed public hearing was held on said Application by the City Council on March 18, 1992, and based upon the evidence presented, including the Applicant's testimony and each member of the City Council being familiar with the Property, it was determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of such Application are present and that the zone variance should be approved. WHEREAS, it is the determination of the City Council that: a) There are exceptional or extraordinary circumstances or conditions applicable to the Property involved which do not generally apply to other property in the same zone; and b) Such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the Property in question, because other single family residential properties in the City and within the neighborhood also contain two 2) or more dwelling units; and c) The granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent properties; and BIB] 37650-U01 1992-U02 025-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1776-U03 DO1887-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESEO-U05 92-25-U05 APR-U05 1-U05 1992-U05 1992 025 CC RESO(Ìì³  Resolution No. 92-25 Page 2 of 2 d) The granting of the variance will not adversely affect the General Plan of the City of Baldwin Park as it will not likely set a precedence leading to a number of similar requests for the construction of second dwelling unitB on undersized lots, in that each variance application must be considered on its own merits. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE that the zone variance Application, as hereinabove described, be and the same hereby is approved. BE IT FURTHER RESOLVED that the City Clerk shall certify to the adoption of this Resolution and shall forward a copy hereof to the Secretary of the Planning Commission and to the Applicant.
