HomeMy WebLinkAbout1992 075 CC RESO1992 075 CC RESO(Ì캑 RESOLUTION NO. 92-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING A REQUEST FOR APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW THE OFF-SITE SALE OF BEER AND WINE IN CONJUNCTION WITH A FISH MARKET. APPLICANT: DAVID TRAN; LOCATION: 4303 N. MAINE AVE. #107; CASE NO.: CP-512). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application Application) for a conditional use permit Permit") was submitted on behalf of the owner of certain real property, located at 4303 N. Maine Ave. #107, in the City of Baldwin Park, described more particularly in the Application on file with the City Planner Planner"); and b) That the Application was sought to allow the off-site sale of beer and wine in conjunction with a fish market Section 17.18.030.A of the City Code); and c) That the Planning Commission, on June 24, 1992, conducted a duly noticed public hearing on said appeal and based upon evidence presented including applicable staff reports and each member of the commission being familiar with the property denied the Application; and d) That the applicant, David Tran, filed a timely appeal from the decision of the Planning Commission with reference to the Permit; and e) That the City Council conducted a duly noticed public hearing upon said matter and determined that the facts required pursuant to the provisions of the Baldwin Park zoning Code for the denying of the Permit were present to wit: 1) That the proposed addition of beer and wine sales could have an adverse impact upon adjacent properties by creating an over-concentration of alcohol sales outlets as evidenced by over one dozen alcohol selling outlets on Maine Avenue alone and three 3) within 500 feet of the subject property; and 2) That he proposed use is in conformance *with the General Plan of the City of Baldwin Park. SECTION 2. That the Permit Application, as herein above described, be and the same is hereby denied. SECTION 3. That the City Council relied upon the evidence presented at the public hearing in making the above findings of fact, and in reaching the conclusion that the Permit should be denied. SECTION 4. That the city Clerk shall certify to the adoption of this Resolution and shall forward a copy thereof the Secretary of the Planning Commission and to the applicant.
