Z. SUN AND ASSOCIATES; CASE NO.: Z-503 AND TM-51200; LOCATION: 4213-4219 DOWNING AVENUE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owners of certain real property approximately 47 acres in area located at 4213-4219 Downing Avenue, more particularly described in the application which is on file in the office of the Secretary of the Planning Commission of the City hereinafter Property") hereto for made said application for a zone change for said property from RG, Residential Garden to RG(PD), Residential Garden Planned Development Overlay Zone therewith a development plan hereinafter Plan") and tentative tract map hereinafter Map") for said Property; and b) That the Planning Commission conducted a duly noticed public hearing upon said matter and recommended that the same be approved, subject to certain conditions; and c) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each member being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) The proposed development containing a maximum density of 10.5 units per acre, is consistent with the land use policies of the General Plan; and b) The proposed development exhibits a superior quality of architecture and site design, and will not be detrimental to surrounding properties; and C) The proposed project represents a logical and rational transition of residential densities between the adjacent RG zoned properties; and d) That the proposed development, consisting of clustered homes and common open space, meets the purpose and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Plan be, and the same hereby is approved, subject to the following conditions: a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated July 22, 1992; and BIB] 37650-U01 1992-U02 081-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1776-U03 DO1825-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 92-81-U05 SEP-U05 2-U05 1992-U05 1992 081 CC RESO(퓼x Resolution No. 92-81 Page 2 of 5 b) The CC&R's shall reflect that the homeowner's association shall maintain all common areas and the landscaping of the front yard area of each lot outside of the walled yard, and that future unit expansions shall be limited to patio covers only, which shall not exceed 25 percent of the lot's countable private open space and shall be architecturally compatible with the existing dwelling; a five 5) foot minimum side and rear yard area shall be maintained; and c) That the CC&R's shall note that the private street is a fire lane, and 0 Parking" signs shall be posted and maintained on the south side for said street; and d) That the CC&R's shall include the City' resolution of approval as an addendum; and e) That design approval is subject to this project meeting all design requirements of the Los Angeles County Fire Department; and f) That all garages shall contain roll up garage doors; and g) That electric garage door openers be provided and maintained for each unit; and h) The applicant shall enter into an agreement for individual on-site pick-up with the refuse company; and i) On-site private street shall be designed as a standard public street" section with a crown along the centerline and an integral curb and gutter, an on-site lighting plan is to be included within the architectural drawings; and j) That the applicant shall submit to the Planning Division landscape and irrigation plans, street light design, and CC&R's for review and approval; and k) That construction shall commence within one 1) year of the effective date of City Council approval, or approval of the development plan is null and void; and l) The applicant shall install all public improvements as required by the Engineering Division and Fire Department; and m) That the applicant shall submit for approval a final map with CC&R's. Said map shall show a common lot which shall include the private street and all common open space areas; and n) That a security alarm system shall be provided for each unit to protect all openings windows and doors) and be pre equipped to link with the City's Police Department; and o) That all block walls, except those portions visible only from within a private yard, shall be stucco coated; and p) That the applicant shall submit for approval a grading plan, soils report and a sewer plan pursuant to City standards; and q) That pursuant to Fish and Game Code Section 711.2, the project will have a de minimis impact on fish and wildlife and that a $25.00 administrative fee must be submitted to the Planning Division made payable to Los Angeles County Clerk) for filing the Certificate of Fee Exemption with the County Clerk; and r) That the applicant shall sign a notarized affidavit within twenty 20) days after the adoption of the City Council BIB] 37650-U01 1992-U02 081-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1776-U03 DO1825-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 92-81-U05 SEP-U05 2-U05 1992-U05 1992 081 CC RESO(퓼x Resolution No. 92-81 Page 3 of 5 resolution that the applicant has read and accepts all the conditions of approval. SECTION 4. That the above described Map be, and the same hereby is granted, subject to the following conditions: a) All conditions of the State Map Act and the City's subdivision Ordinance must be met prior to recordation; and b) All conditions of the Los Angeles County Fire Department including on-site access and circulation must be met prior to recordation; and c) All special assessments and utilities or sewer connection fees are to be paid prior to recording the final map; and d) All requirements of the serving utilities are to be met or guaranteed prior to recording of the final map; and e) Submit a Subdivision Guarantee to this office; and f) The final map shall be based on a field survey; and g) All surveying for the proposed development will be done by the developer, including the establishment of Centerline ties; and h) Enclose with the final map the surveyor's closure sheets; and i) Prior to Building Permit issuance, a grading plan prepared by a Registered Civil Engineer must be approved by the City Engineer; and j) All improvements plans required for this development must be submitted with the final map before plan check will commence; and k) All improvement plans must be submitted in triplicate; and 1) Submit to this office a Geologic/Soils Report signed by Registered Soils Engineer and drawn to the satisfaction of the City Engineer; and m) Sewer plans, signed by a Registered Civil Engineer and designed and drawn to the satisfaction of the City Engineer, must be submitted if an on-site mainline facility is proposed; and n) Each building must have a separate and independent connection to a mainline sewer; and 0) Each building must have a separate and independent connection to a mainline sewer; and i) Remove existing substandard drive approach(es) and replace with full height curb and gutter; and ii) Construct concrete drive approach per City Standard A-2 on Downing Avenue; and iii) Install on-site mainline sewer trunk to serve each unit; and iv) Install separate sewer lateral for each unit; and BIB] 37650-U01 1992-U02 081-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1776-U03 DO1825-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 92-81-U05 SEP-U05 2-U05 1992-U05 1992 081 CC RESO(퓼x Resolution No. 92-81 Page 4 of 5 v) Install three 3) parkway tress on Downing Avenue per City Standard C-1; and vi) Install all utilities underground to site; and vii) Install parkway irrigation system and landscaping on Downing Avenue; and viii) Underground all existing utilities along Downing Avenue; and ix) Construct a new 5' wide sidewalk; 15'-6" from face of curb to back of walk; and x) Remove substandard curb and replace with full height curb and gutter per City standard; and xi) Reconstruct pavement 1/2 width) along Downing Avenue; and p) The following plans shall be prepared by a Registered Civil Engineer: i) Grading Plan. 24" x 36" plan showing all off-site improvements on plan; and ii) Sewer Connection Plan. To be addressed on Grading Plan); and iii) Street reconstruction plan; and q) After the final map records, a sepia and two blueline prints shall be submitted to the Engineering Division at no cost to the City. Final occupancy will not be granted until the recorded map is received by the Engineering Division; and r) Ten 10) feet of easement for on-site sewer trunk, 8" minimum, shall be dedicated on final map and sewer plan or by separate instrument; and s) On-site street lighting plan. To be included in the architectural plans); and t) Prewire and otherwise make ready future cable TV connections for all residential units constructed on this property; and u) Approval of this tentative map does not constitute approval of a site plan or building footprints; and v) On-site private street shall be designed as a standard public street" type section with a crown along the centerline and an integral curb and gutter; and w) Draft CC&R's. will be reviewed and approved by the City Attorney prior to approval of the Final Tract Map. SECTION 5. That the City Council relied upon the Administrative Record, and evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Plan and Map should be conditionally approved. SECTION 6. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of the CEQA Guidelines, and the City's procedures. That this resolution shall not become effective until after the effective date of the ordinance approving the rezoning of Property from RG to RG(PD). SECTION 8. That the City Clerk shall certify to the adoption of this resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The Secretary of the Planning Commission shall file the Notice of Determination and Negative Declaration of Environmental Impact. PASSED AND APPROVED on September 2, 1992. ATTEST LINDA L.
