HomeMy WebLinkAbout1992 084 CC RESO1992 084 CC RESO(퓼Z RESOLUTION NO. 92-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING THE SIDE LETTERS OF AGREEMENT RELATING TO ALTER- NATE WORK SCHEDULES WHEREAS, the City has met and conferred with the Baldwin Park Police Association, the Baldwin Park Management Association, the Professional & Technical Employees Association, S.E.I.U., Local 347, and has consulted with the Confidential Employees, regarding alternate work schedules for their respective city employees: NOW, THEREFORE, the City Council of the City of Baldwin Park does resolve as follows: SECTION 1. The side letters of agreement attached hereto as Exhibit A" Baldwin Park Police Association), Exhibit B" Baldwin Park Management Association), Exhibit C" Professional & Technical Employees Association), Exhibit D" S.E.I.U, Local 347) and Exhibit E" Confidential Employees) are hereby approved and adopted and the City Manager is authorized to execute same on behalf of the City. SECTION 2. All Resolutions or portions thereof in conflict herewith are hereby rescinded. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and shall forward a certified copy hereof to the City Manager, each Department Head of the City and the Personnel Officer. This Side Letter of Agreement has been developed as a result of the requests of the Baldwin Park police Association. This side Letter of Agreement is subject to the approval of the City Council of the City of Baldwin Park and will be placed into effect upon the adoption of the necessary ordinances and resolutions by the City Council, if acceptable to them, in accordance with the terms and conditions hereinafter set forth. Experimental 4/10 Plan The City agrees to implement an experimental 4/10 plan for all employees in the Police Department /1/ effective August 2, 1992. The Association recognizes that the City may, at its sole dis- cretion, end the 4/10 plan at any time. The termination of such 4/10 plan is not subject to the grievance process or any other administrative review. The Association recognizes that the 4/10 plan is not a vested right in any manner, and that the termination of such 4/10 plan is not subject to the meet and confer process or meet and consult process. The Association further recognizes that the implementation of the 4/10 plan does not create any additional overtime obligation for the City under the Fair Labor Standards Act. The City may adjust employees work periods as necessary so that their forty 40) hours of scheduled work does not overlap into another work period to avoid an overtime obligation. Workday Section 4, Workday page 8) of the 1991/92 Memorandum of Under- standing MOU") shall be modified to read as follows: For employees assigned to patrol and dispatch duty a standard workday consisting of ten 10) hours, including a paid restricted meal period of one-half 1/2) hour. Meal periods shall be in accordance with department administrative guidelines. /1/ The switchboard operator shall remain on a 5/8 schedule until such time as the City Hall employees transition to a 4/10 plan. Meal periods shall be in accordance with department administrative guide- lines. Employees will be provided two 2) ten 10) minute rest breaks during the day, one each approximately at the midpoint of each one-half workday. Rest time is not cumulative beyond the half scheduled workday within which the break period occurs nor may it be used to extend lunch or shorten the workday. Hours of Work Non shift employees except detectives and records clerks assigned to Investigations) shall work Monday through Thursday, 7:30 a.m. to 6:00 p.m. Detectives and records clerks assigned to Investigations shall work either Monday through Thursday or Tuesday through Friday as determined and assigned by the department), 7:00 a.m. to 5:30 p.m. Sick Leave Sick leave shall continue to accrue on an hourly basis per month and shall be debited on an hourly basis. Vacation Section 11.3 of the Personnel Rules shall be modified to reflect accruals based on an hourly basis. Each work day" set forth in the current Section 11.3 shall be converted to eight 8) hours; i.e., an employee having over twenty 20) years of service with the city shall accrue sixteen 16) hours per calendar month. Bereavement Leave Section 2, Bereavement Leave page 5) of the 1991/92 MOU shall be modified to read as follows: Each affected employee in the covered classifications shall be allowed to use a maximum of twenty-four 24) hours per calendar year to be utilized for bereavement leave, because of a death in their immediate family. Immediate family shall mean and in- clude only the employee's spouse, children, stepchildren, parents, spouse's parents, grandparents, spouse's grandparents, brothers and sisters. Said time will not be cumulative from one twelve month period to another nor will pay in lieu of unused leave for bereavement be provided. Jury Duty An employee granted jury duty leave pursuant to Section 11.7 of the Personnel Rules shall not be granted additional compensation when such leave extends beyond the employees regularly scheduled four 4) work days per week to his/her Friday" day off. Training/Conference Leave When an employee is scheduled to attend a conference or training program Monday through Friday, his/her work hours will be 8:00 a.m. to 5:00 p.m., Monday through Friday, so there is no issue that he/ she is eligible for overtime while attending the conference or training. Injury on Duty The language will remain as is stated in the 1991/92 MOU on page 16) While any employee is on injury on duty status, his/her work hours will be 8:00 a.m. to 5:00 p.m., Monday through Friday, so there is no issue that he/she is eligible for overtime while re- ceiving treatment or keeping doctor's appointments. Holidays Section 2, Holidays pages 4-5) of the 1991/92 MOU shall be modified to read as follows: Every employee shall be entitled to the following holidays with pay each calendar year and such other days as may be designated by action of the City Council: 1. January 1 New Year's Day 2. The third Monday in February President's Day 3. The last Monday in May Memorial Day 4. July 4th 5. The first Monday in September Labor Day 6. November 11 Veteran's Day 7. The fourth Thursday in November Thanksgiving Day 8. December 24 Christmas Eve 9. December 25 Christmas Day A. Shift Employees Employees assigned to shifts other than normal business hours patrol division, dispatchers, and records clerks) shall be eli- gible for a ten 10) hours leave with pay each year for observance of Martin Luther King Day. The actual date for the use of such leave shall be within the calendar year and subject to the approval of the employee's appointing authority. For good cause,upon written request to, and approval of the City Manager, an employee may be permitted to carry over holiday time. Employees assigned to shifts other than normal business hours patrol division, dispatchers, and records clerks) shall receive ten 10) hours cash payment at their straight time rate for each holiday as it occurs, other than Martin Luther King. B. Non-shift Employees If any of the aforementioned holidays fall on a Friday or a Saturday, the holiday will not be observed on the preceding Wednesday or Thursday. If any of the holidays fall on a Sunday, the Monday following is the holiday in lieu thereof. At the beginning of each calendar year, the City will determine how many of the above holidays fall on a Friday and/or Saturday. An employee will be credited with an equivalent number of hours of holiday time holiday bank"). Each affected non-shift em- ployee will also be credited with ten 10) hours leave each year for observance of Martin Luther King Day. The actual date for the use of such leave shall be within the calendar year and subject to the approval of the employee's appointing authority. Said time can not be accrued and, if not used within the stated one year period of time will be lost. For good cause, upon written request to, and approval of the City Manager, an employee may be permitted to carry over holiday time. If an employee separates employment from the City, and has used holiday bank time prior to the occurrence of the actual holiday, he/she will have his/her vacation bank and/or final paycheck reduced to reflect the excess holiday bank time used. If an employee separates employment from the City, and has not used any eligible accrued holiday bank time, he/she will be paid for such eligible holiday bank time at his/her straight time rate. C. Birthday Leave Section 2, Birthday Leave page 5) of the 1991/92 MOU shall be eliminated. Each affected employee in the covered classifications who has not used his/her 1992 Birthday leave, as of December 31, 1992, will be credited with eight 8) hours of compensatory time on January 1, 1993. D. 1992 Martin Luther King Day Each affected employee in the covered classifications who has not used his/her floating holiday for the observance of Martin Luther King Day, as of December 31, 1992, will be credited with eight 8) hours of compensatory time on January 1, 1993. Other Holidays The City and the Association agree to initiate discussion relating to other holidays no later than October 1, 1992. Employees may accumulate up a maximum of one hundred 100) hours of holiday bank time. An employee will be notified by their department, thirty 30) days in advance that their holiday bank time will be in excess of the allowable amount prior to the loss of the excess accrued. For good cause, upon written request to, and approval of the City Manager, an employee may be permitted to carry over holiday time. If an employee separates employment from the City, and has used holiday bank time prior to the occurrence of the actual holiday, he/she will have his/her vacation bank, administrative leave and/or final paycheck reduced to reflect the excess holiday bank time used. If an employee separates employment from the City, and has not used any eligible accrued holiday bank time, he/she will be paid for such eligible holiday bank time at his/her straight time rate. C. D. 1992 Martin Luther King Day Each affected employee in the covered classifications who has not used his/her floating holiday for the observance of Martin Luther King Day, as of December 31, 1992, will be credited with eight 8) hours of administrative leave on January 1, 1993. E. Classifications Not Affected by Alternate Work Schedule The classifications of Maintenance Superintendent and Citizen Services Manager, which are not subject to the alternate work schedule will be covered by the current language, as outlined in the 1991/92 MOU for the following areas: Section 2.4 Holi- days, Section 2.5 Birthday Leave, and Section 2.8 Bereavement Leave, until such time as those classifications may become sub- ject to an alternate work schedule. F. Floating Holiday Time The classifications of Maintenance Superintendent and Citizen Services Manager will be credited with four 4) hours of floating holiday time on January 1, 1993. The actual date for the use of such leave shall be within one year of each January 1 and subject to the approval of the employee's appointing authority. Said time can not be accrued and, if not used within the stated one year period of time will be lost. This four 4) hours of floating holiday time credited each January 1, will continue until such time as those classifications may become subject to an alternate work schedule. This Side Letter of Agreement has been developed as a result of the requests of the General Unit of Employees, City of Baldwin Park, S.E.I.U., Local 347. The items in this agreement are sub- ject to the approval of the City Council of the City of Baldwin Park and will be placed into effect upon the adoption of the nec- essary ordinances and resolutions by the City Council, if acceptable to them, in accordance with the terms and conditions hereinafter set forth. Experimental 4/10 Plan The City agrees to implement an experimental 4/10 plan for all employees assigned to City Hall effective September 27, 1992. The Union recognizes that the City may, at its sole discretion, end the 4/10 plan upon reasonable notification to the Union. The termination of such plan is not subject to the grievance process or any other administrative review. The Union recog- nizes that the 4/10 plan is not a vested right in any manner, and that the termination of such 4/10 plan is not subject to the meet and confer process or meet and consult process. The Union further recognizes that the implementation of the 4/10 plan does not create any additional overtime obligation for the City under the Fair Labor Standards Act. The City may adjust employees work periods as necessary so that their forty 40) hours of scheduled work does not overlap into another work period to avoid an overtime obligation.
