A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK GRANTING A
TIME EXTENSION TO THE APPROVAL OF A
DEVELOPMENT PLAN AND TENTATIVE
TRACT MAP APPLICANT: PATRICK CHIU;
LOCATION: 4327-4349 LA RICA AVENUE;
CASE NO.: Z-500 AND TM 48748).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine, and declare, as follows:
a) That letters were submitted requesting a one
1) year time extension to approval of the Development
Plan and Tentative Tract Map for property located at
4327-4349 La Rica Avenue, in the City of Baldwin Park,
more particularly described in the Case File No. Z-500,
on file with the City Planner; and
b) That the Development Plan and Tentative Tract
Map were initially approved August 1, 1990, in
conjunction with a Change, of Zone, and that the City
Council resolution of approval of the Development Plan
Resolution No. 90-59) states as a condition of approval
that construction shall commence within one 1) year of
the effective date of City Council approval, or approval
of the Development Plan is null and void; and
c) That the City Council, on August 7, 1991,
granted a one 1) year time extension of the Development
Plan Resolution No. 91-57), and that the approved
Tentative Tract Map had an initial life of two 2) years
to be finaled; and
d) That the project applicant has been unable to
fulfill the above stated conditions of approval and has
therefore requested the time extensions in a timely
manner; and
e) That the Development Plan provides for sixteen
16) detached single family residential dwelling units
on 2.14 acres of land, and remains unchanged in concept
and design, and therefore continues to meet the purpose
and intent of the Planned Development Overlay Ordinance.
f) That based upon the evidence provided, the
City Council has determined that the time extension
requests should be granted.
SECTION 2. That the City Council does hereby approve a
one 1) year time extension to the Development Plan and Tentative Tract
Map for property located at 4327-4349 La Rica Avenue, which will expire
on August 1, 1993.
SECTION 3. That the City Clerk shall certify to the
adoption of this Resolution and shall forward a certified copy hereof to
the Secretary of the Planning Commission and to the applicant.
APPROVED AND ADOPTED this day of October 7 1992.
