A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK APPROVING THE FINAL
DRAFTS OF THE SOURCE REDUCTION AND RECYCLING
ELEMENT AND THE HOUSEHOLD HAZARDOUS WASTE
ELEMENT AND APPROVING AND ADOPTING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT
WHEREAS, the State of California enacted the Integrated Waste
Management Act in 1989 mandating local governments to reduce the amount
of waste being disposed from their jurisdictions by at least 25 percent
by 1995 and 50 percent by the year 2000; and
WHEREAS, the City Council of the City of Baldwin Park has adopted
goals, objectives and priorities for the formulation of waste management
plans; and
WHEREAS, the Final Draft Source Reduction and Recycling Element and
the Household Hazardous Waste Element specify the programs and
activities which will be utilized to reach the mandated reduction
levels; and
WHEREAS, the proposed Negative Declaration of Environmental Impact
indicates that these activities do not involve a significant adverse
effect upon the environment, but rather improve the environment through
reducing materials requiring disposal; and
WHEREAS, the Negative Declaration further offers no evidence that
the Elements would have a potential adverse impact upon wildlife
resources;
NOW, THEREFORE, be it resolved as follows:
SECTION 1. That the City Council hereby approves and adopts the
Final Drafts of the Source Reduction and Recycling Element and the
Household Hazardous Waste Element.
SECTION 2. That the City Council at the time of the public hearing
for the above matter, reviewed and considered the proposed Negative
Declaration, and comments relating thereto. That the City Council, based
upon its public review, does hereby approve, adopt and order filed the
proposed Negative Declaration, since there is no substantial evidence
that the project will have a significant adverse effect on the
environment.
SECTION 3. That in conjunction with the Negative Declaration, the
City Council considered and does hereby approve, adopt and order filed
with the California Department of Fish and Game, Certificate of Fee
Exemption of De Minimis Impact Finding, as the environmental analysis
offers no substantial evidence that the proposed Elements will have
potential for an adverse effect, either individually or cumulatively, on
wildlife resources, as defined in Section 711.2 of the Fish and Game
Code.
SECTION 4. That the City Clerk shall certify to the adoption of this
Resolution and shall forward a copy of the same to the Secretary of the
Planning Commission. The Secretary of the Planning Commission shall file
the Negative Declaration of Environmental Impact and De Minimis Impact
Finding in the manner prescribed by law.
