HomeMy WebLinkAbout1993 019 CC RESO1993 019 CC RESO(퓼 RESOLUTION NO. 93-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A SPECIFIC PLAN ENCOMPASSING APPROXIMATELY 16.5 ACRES OF LAND TO ENSURE THE COORDINATED DEVELOPMENT OF THE PROPERTY FOR COMMERCIAL PURPOSES APPLICANT: JACK IN THE BOX; CASE NO. SP 93-1; LOCATION: 3060-3188 BALDWIN PARK BLVD. EVEN ADDRESSES), 13616-13766 FRANCISQUITO AVE. EVEN ADDRESSES), 13619-13791 E. GARVEY AVE. ODD ADDRESSES), AND 3013-3090 N. MAINE AVE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That Jack-in-the-Box Applicant") heretofore filed an application Application") requesting approval of a Specific Plan in Case No. SP 93-1 Plan") pursuant to Section 65440 et seq. of the Government Code to ensure the coordinated development for commercial purposes on certain real property located more particularly in the application which is on file in the office of the Secretary of the Planning Commission of the City Property"), and environmental analysis, Case No. SP 93-1; and b) That the Planning Commission held a duly noticed public hearing on the proposed Plan, and has recommended approval of the said environmental analysis and approval of the proposed Plan; and c) That the Plan as proposed is consistent with the purpose and intent of the Sierra Vista Redevelopment Project Area Plan and the General Plan and their goals and objectives; and d) That the City Council has conducted a noticed public hearing upon the said matter, and based upon the evidence presented has determined that the Specific Plan should be approved; and e) That the proposed Specific Plan, as above described, is in the public interest and will promote the general welfare. SECTION 2. That the City Council relied upon the Administrative Record, and evidence presented at the public hearing, in reaching the conclusion that the Plan should be approved. SECTION 3. That the Specific Plan, on file in the Office of the City Planner, marked Specific Plan SP 93-1", be the same hereby is, adopted and shall be operative as of the date of adoption of this resolution. The original of the Specific Plan is on file with the City Clerk. SECTION 4. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration. That the City Council based upon its public review, does hereby approve, adopt, and order filed the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 5. SECTION 6. That the City Planner shall note the existence of the Plan on the City's official Zoning Zap as adopted pursuant to Section 17.06.020 of the Baldwin Park Zoning Code. SECTION 7. That the City Planner shall be responsible for the implementation and enforcement of the provisions of the Plan. SECTION 8. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission. The Secretary of the Planning Commission, on behalf of the City Clerk shall file the Negative Declaration and Certificate of Fee Exemption. APPROVED AND ADOPTED ON FEBRUARY 17TH, 1993 MAYOR LINDA L.
