A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ADOPTING A
LANDSCAPE DESIGN MANUAL APPLICANT:
CITY OF BALDWIN PARK; CASE NO.:
DRG-93-1).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine, and declare as follows:
a) That the City of Baldwin Park Applicant")
heretofore filed an application Application")
requesting approval a Landscape Design Manual
Manual"), applicable to specified development projects
and in satisfaction of the State Water Conservation in
Landscaping Act; and
b) That the Planning Commission held a duly
noticed public hearing on the proposed Manual, and has
recommended approval of the Negative Declaration of
Environmental Impact and adoption of the proposed
Manual; and
c) That the City Council has conducted a noticed
public hearing on said matter, and based upon the
evidence presented has determined that the Manual should
be adopted; and
d) That the Manual as proposed is consistent with
the intent and requirements of Chapter 17.44 of the
Municipal Code, the General Plan, and the State Water
Conservation in Landscaping Act; and
e) That the proposed Manual, as above described,
is in the public interest and will promote the general
welfare.
SECTION 2. That the Manual, Case No. DRG-93-1, is
hereby approved and adopted.
SECTION 3. That the City Council relied upon the
Administrative Record, and evidence presented at the public hearing, in
reaching the conclusion that the Manual should be approved.
SECTION 4. That the City Council at the time of the
public hearing on the above matter reviewed and considered the proposed
Negative Declaration. That the City Council based upon its public
review, does hereby approve, adopt, and order filed the proposed
Negative Declaration, since there is no substantial evidence that the
project will have a significant impact on the environment.
SECTION 5. That in conjunction with the Negative
Declaration, the City Council considered and does hereby approve, adopt
and file the California Department of Fish and Game, Certificate of Fee
Exemption for De Minimis Impact Finding, as the environmental analysis
offers no substantial evidence that the proposed Manual will have
potential for an adverse effect, either individually or cumulatively, on
wildlife resources, as defined in Section 711.2 of the Fish and Game
Code.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution, and shall forward a copy hereof to the
Secretary of the Planning Commission. The Secretary of the Planning
Commission, on behalf of the City Clerk, shall file the Negative
Declaration and Certificate of Fee Exemption.
