HomeMy WebLinkAbout1993 039 CC RESO1993 039 CC RESO(Ììµµ RESOLUTION NO. 93-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE RENEWAL OF THE MODIFICATION TO AN EXISTING CONDITIONAL USE PERMIT APPLICANT: MICHAEL 0. GRAHAM; LOCATION: 12766-12770 TORCH STREET; CASE NO: CP-314) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owner Applicant") of certain real property located at 12766-12770 Torch Street, more particularly described in the said application Application") which is on file in the office of the Secretary of the Planning Commission of the City hereinafter Property") heretofore made application for a renewal of the modification to an existing conditional use permit, as hereinafter described; and b) That the Application seeks permission to allow six 6) additional foster home residents, to total thirty-four 34), at the existing facility Section 17.12.030 of the City Code); and c) That the Planning Commission, on January, 27, 1993, conducted a duly noticed public hearing on said Application, and based upon the evidence, including applicable staff reports and each member of the Commission being familiar with the property, voted to approve the Application; and d) That the Appellant, Baldwin Park School District, filed a timely appeal of the Planning Commission's decision to the City Council; and e) That a duly noticed public hearing was held on said Application by the City Council on April 7, 1993, and based upon the evidence presented including applicable staff reports and each member of the City Council being familiar with the Property, it was determined that the facts required pursuant to the provisions of the Baldwin Park zoning Code for the granting of such Application are present and that the Permit should be granted, subject to the terms of this Resolution. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the 65 acre site is adequate in size and shape to accommodate the three 3) buildings and the proposed use at the capacity being requested; and b) That the site has sufficient access to streets and highways adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use, as the subject property has access to Torch Street; and c) That the proposed use will not have an adverse effect upon uses adjacent to the subject property, as the site has been developed with sufficient accommodations to house the additional residents, the twenty-four 24) hour supervision and staffing of the facility at one 1) child care counselor per five 5) resident as required in the Youth Centers' Programmatic Statement" is adequate to mitigate any negative affects the facility may cause; and BIB] 37650-U01 1993-U02 039-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1127-U03 DO1145-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 93-39-U05 APR-U05 7-U05 1993-U05 1993 039 CC RESO(Ììµµ Resolution No. 93-39 Page 2 of 2 d) That the proposed use is in conformance with the City's General Plan because the development and proposed use are consistent with the City's goals and standards. SECTION 3. That the Conditional Use Permit be, and hereby is, granted, subject to the following conditions: a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated January 27, 1993; and b) That the use of the subject property be limited to thirty-four 34) foster home residents; and c) That the Programmatic Statement for the Eggleston Youth Center" Exhibit B" dated January 27, 1993) shall be strictly adhered to; and d) That the applicant shall comply with all conditions of approval or CP-314 shall become null and void and will be subject to revocation. Any cost associated with the revocation of this conditional use permit will be paid by the applicant and/or owner; and e) That the applicant shall sign a notarized affidavit within forty 40) days after the adoption of this resolution stating that the applicant accepts all of the conditions of approval. SECTION 4. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Permit should be granted. adoption of SECTION 5.
