A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK, CALIFORNIA, URGING
THE COUNTY REGISTRAR OF VOTERS TO
DISCONTINUE MANDATORY ABSENTEE VOTING AT
VARIOUS PRECINCTS LOCATED IN THE CITY OF
BALDWIN PARK.
WHEREAS, California Elections Code Section 1005 vests in
the County Registrar of Voters discretion to furnish or not to
furnish each voter with an absentee ballot along with a
statement that there will be no polling place for the election,
whenever there are 250 or less persons registered to vote in
any precinct;" and
WHEREAS, the County Registrar of Voters has so chosen to
furnish voters with absentee ballots along with a statement
that there will be no polling place for the election in
numerous precincts in the City of Baldwin Park because there
were 250 or less registered voters in these precincts; and
WHEREAS, said action by the County Registrar of Voters is
tantamount to mandatory absentee voting;" and
WHEREAS, registered voters of Baldwin Park located in
precincts consisting of 250 or less registered voters, wherein
mandatory absentee voting has been imposed, have expressed a
desire to vote in-person at a polling place in the precinct;
and
WHEREAS, voting in-person at a polling place is probably
less susceptible of voting impropriety and fraud than absentee
ballot voting; and
WHEREAS, if the County Registrar of Voters were to allow
in-person voting at a polling place in Baldwin Park precincts
consisting of 250 or less registered voters, those voters
wishing to vote by. absentee ballot may still do so pursuant to
law;
NOW, THEREFORE, IT IS RESOLVED as follows:
The County Registrar of Voters is hereby urged to open
polling places in precincts consisting of 250 or less
registered voters in the City of Baldwin Park, allow in-person
voting at these polling places; and discontinue mandatory
absentee voting" in these precincts.
PASSED, APPROVED AND ADOPTED this 1st day of December,
1993.
