A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK APPROVING AN AMENDMENT TO THE LAND USE ELEMENT MAP
OF THE CITY'S GENERAL PLAN FROM SINGLE FAMILY RESIDENTIAL
TO NEIGHBORHOOD COMMERCIAL APPLICANT: USA GASOLINE
CORPORATION: CASE NO.: AGP-96; ADDRESS: 14874-78 PACIFIC
AVENUE).
THE PLANNING COMMISSION OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and
declare as follows:
a) That pursuant to the applicable provisions of the Planning Law Section 65300
et.seq. and 65800 et. seq. of the Government Code of the State of California), studies were
commenced for the purpose of considering the need for an amendment to the Land Use
Element Map of the General Plan: and
Z) That the Planning Commission has conducted a duly noticed public hearing on the
proposed amendment to the said Element, Case No. AGP-96 as shown on Exhibit D" on file
in the Planning DMsion of the City, and an environmental analysis; as hereinafter described;
and
c) That the Planning Commission has recommended denial of said proposed
amendment and zone change: and
d) That the City Council has conducted a noticed public hearing on said matter and
has determined that the public interest requires the approval of Case No. AGP-96 to amend
the Land Use Element Map of the General Plan for the property located at 14874-78 Pacific
Avenue, as shown on said exhibit: Amendments"): and
e) That the Amendments as proposed are consistent with the purposes and intent
of the General Plan and its goals and objectives: and
1) That the Amendments are required and are in the public interest and will promote
the general welfare.
SECTION 2. That the City Council at the time of the public hearing on the above matter
reviewed and considered the proposed Negative Declaration, relating to the Amendment AGP-96). That the
City Council based upon its public review, does approve the proposed Negative Declaration, since there is no
substantial evidence that the project will have a significant impact on the environment.
SECTION 3. That the Amendment to the City's General Plan, be, and hereby is, approved.
SECTION 4. That the City Clerk shall certify to the adoption of this resolution and shall forward
a ce[tified copy, hereof to the Secretary of the Planning Commission and to the applicant. The Secretary of the
Planning Commission shall file the Negative Declaration of Environmental Impact.
