HomeMy WebLinkAbout1994 125 CC RESO1994 125 CC RESO(Ìì¸@ RESOLUTION NO.94-125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CONDITIONAL USE PERMIT APPLICANT: USA GASOLINE CORPORATION: CASE NO.: CP-526: LOCATION: 3665 N. PUENTE AVENUE AND 14878 PACIFIC AVENUE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin park does hereby find, determine and declare as follows: a) That the application Application") for a conditional use permit Permit") was submitted on behalf of the owner of certain real property, located at 3665 N. Puente Avenue and 14878 Pacific Avenue, in the City of Baldwin Park, described more particularly in the Application on file with the City Planner Planner"); and b) That the Application was sought to allow an automobile service station and mini- market, pursuant to Section 17.17.18.030.B of the City Code: and c) That a duly noticed public hearing was held on the above said Application by the City Council, and based upon the evidence presented, including applicable staff reports and each member of the Council being familiar with the property, it was determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of a conditional use permit were present and that the Permit should be granted, subject to the terms of this Resolution. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the 22,726 square foot 52 acre) site is adequate in size and shape to accommodate the proposed use as the site contains adequate on-site circulation and maneuvering to efficiently operate the proposed automobile service station and mini-market; and b) That the site has sufficient access to streets and highways adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use,as the proposed automobile service station and mini-market has been designed to have access onto both Pacific and Puente Avenues which have been designated as collector streets in the City's General Plan; and c) That the proposed automobile service station and mini-market will not have an adverse effect upon uses adjacent to the subject property, as the site is to be developed in compliance with the City's development standards regulating service stations and in accordance with the conditions imposed so as not to create any unsightly views and provide adequate buffering so as to be compatible with the adjacent uses; and d) That the proposal is consistent with Goal #2.2 of the City's General Plan Land Use Element, as the proposed site layout, which is designed such that no vehicle has to back out onto the public street and has ample room for on-site maneuvering, provides for a safe and adequate street access; and SECTION 3. That the Conditional Use Permit be, and the same is hereby granted, subject to the following conditions: a) That the site shall be developed and maintained in substantial compliance with Exhibit A" dated October 26,1994; and b) That all signs require a separate permit and shall be subject to review by the City's BIB] 37650-U01 1994-U02 125-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1461-U03 DO1473-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 94-125-U05 NOV-U05 16-U05 1994-U05 1994 125 CC RESO(Ìì¸@Resolution No.94-125 Page 2 Design Review Committee, and be compatible with the architecture of the building; and c) That the applicant shall submit a detailed Landscape and Irrigation Plan to the Planning Division for review and approval during the Plan Check phase of this project; and d) That the applicant shall sign a notarized Maintenance of Landscaping Agreement within forty 40) days of the date of approval of the City Council Resolution; and e) That the applicant shall operate and maintain the subject property in a neat and orderly fashion; that the site shall be free of litter; and that all graffiti shall be removed within twenty-four 24) hours at the expense of the applicant and/or owner; and I) That the applicant shall complete a parcel map for reversion to acreage for the two 2) parcels; and g) That the following off-site improvements will be required for this project: i) Remove the existing 4' sidewalk and replace with 10' sidewalk from face of curb to back of sidewalk along entire frontage of project; and ii) Remove all drive approaches not being utilized with full height curb; and iii) Plant eight 6) street trees; and iv) The applicant shall make a payment of $15,000 to the Public Works Department for the installation of left turn phase on the existing traffic signal at the intersection of Puente Avenue and Pacific Avenue; and v) Remove existing handicap ramp and construct new per Caltrans standards; and h) That a Grading Plan will be required by a Registered CMI Engineer; and 0' That the development shall meet the N.P.D.E.8. compliance; and 1)That the applicant shall comply with all conditions of approval within six 6) months after the date of the approval or CP-526 shall become null and void and will be subject to revocation. Any cost associated with the revocation of the conditional use permit shall be paid by the applicant and/or owner; and k) That the applicant shall sign a notarized affidavit within forty 40) days of the date of approval of the City Council resolution, stating that the applicant has read and accepts all of the conditions of approval. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and forward a copy hereof to the Secretary of the Planning Commission and the Applicant.
