HomeMy WebLinkAbout1995 007 CC RESO1995 007 CC RESO(Ìì´ RESOLUTION NO.95 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ALONG THE SOUTHSIDE OF FRANCISQUITO AVENUE AND BALDWIN PARK BOULEVARD DISTRICT NO.95-i) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: WHEREAS, Chapter 13.08 of the City of Baldwin Park Municipal Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to as certain whether public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in any such district; and WHEREAS, District 95-1 will be established as a Rule 20A Project; and WHEREAS, it has been recommended that such underground utility district, hereinafter called District, be formed in the area generally described as that portion of the southside of Francisquito Avenue between Baldwin Park Boulevard and the railroad tracks, and the eastside of Baldwin Park Boulevard between Francisquito Avenue and the I 10 Freeway. NOW, THEREFORE, BE IT RESOLVED: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Baldwin Park on March 15, 1995, at the hour of 7:00PM in the Council Chambers of the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying the underground installation of wires and facilities for supplying electric, communication or similar or associated services in the District hereinafter described. 2. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued as determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten 10) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled, Underground Utility District No.95-1 which is on file in the office of the City Clerk of the City of Baldwin Park. Such notification shall be made by mailing a copy of this Resolution together with a copy of said Chapter 13.08 of the City of Baldwin Park Municipal Code to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; and RESOLVED, FURTHER, that the City Council hereby finds and determines as follows: SECTION 1 The Underground District herein created is in the general public interest for the following reasons: 1 The under grounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities-, BIB] 37650-U01 1995-U02 007-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1366-U03 DO1455-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 95-7-U05 JAN-U05 18-U05 1995-U05 1995 007 CC RESO(Ìì´Establish Underground Resolution No.95 7 Utility District No.95-1 Page Two 2. The streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic; 3. The said streets, roads or rights-of-way adjoin or pass through a proposed commercial development. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution and shall cause the same as to be published or posted in the manner prescribed by law APPROVED AND ADOPTED January 18,1995.
