RESOLUTION NO.95- 16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN APPEAL FOR CONDITIONS #14A, D, AND E FOR TENTATIVE PARCEL MAP 1282 WHEREAS, an application for Tentative Parcel Map 1282 was submitted on behalf of John Gerard, Jr., the owner of certain real property located at 3285 North Frazier Street, in the City of Baldwin Park, described more particularly in the application on file with the Director of Public Works: and WHEREAS, the application is to subdivide the land into three parcels within the R-1 Zone; and WHEREAS, the applicant proposes to construct two new single family homes and remodel the existing house; and WHEREAS, on January 25,1995, the Advisory Agency held a duly noticed public hearing and voted to conditionally approve this application; and WHEREAS, D. Barton Doyle on behalf of John Gerard Jr. filed a timely appeal of the Advisory Agency's decision to the City Council; and WHEREAS, a duly noticed public hearing was held on said appeal by the City Council on February 15,1995; and NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. Findings of Fact. Based upon the evidence presented, including applicable staff reports and each member of the City Council being familiar with the property, it is hereby determined that the applicant has failed to show, to the reasonable satisfaction, that the proposed conditions #14 A, D and E are not reasonable or are not in compliance with the City Code and State Subdivision Map Act. A. One new house has frontage along Frazier Street and the other new house has frontage along Waco Street. The existing house has frontage on both streets. Pursuant to Section 15.04.140 of the City's Municipal Code, the developer is required to construct all off-site improvements for the construction or reconstruction of any building or structures when a subdivision map is proposed or the estimated cost is in excess of $20,000. This condition applies to small additions to existing structures, as well as, a new structure. Condition #14A. Drive Approach is required to comply with ADA requirements. Condition #14D. Waco Street, fronting the development, has deteriorated and needs to be reconstructed. Condition #1 4E. Parkway along Waco Street, fronting the development lacks landscaping. It is required that the parking be connected to the irrigation system and be landscaped. That the City Council relied upon the Administrative Records, and the evidence presented at the public hearing, in making the Findings of Fact, and in reaching the conclusion that the appeal should be denied. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall forward a copy hereof to the Director of Public Works and to the applicant.
