HomeMy WebLinkAbout1995 022 CC RESO1995 022 CC RESO(Ìì¸ RESOLUTION NO.95 22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT 95-1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK: WHEREAS, by Resolution No.95-7 a public hearing was called for March 15,1995 at the hour of 7:00PM in the Council Chambers in the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electricity, communication or similar or associated service, within those certain areas of the City of Baldwin Park, County of Los Angeles, State of California, generally described as Underground Utility District No.95-1 located generally along the southside of Francisquito Avenue and eastside of Baldwin Park Boulevard; and WHEREAS, District 95-1 is a Rule 20A Project; and WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized asssessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Baldwin Park, that pursuant to Chapter 13.08 of the City of Baldwin Park Municipal Code, the area described herein is hereby declared Underground Utility District, and is designated a Underground Utility District No.95-1 of the City of Baldwin Park. Attached hereto and hereby incorporated as a part ot this Resolution, is the map marked Exhibit A" delineating the boundaries of said District; and RESOLVED, FURTHER, that the City Council does hereby set December of 1995 as the date in which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electricity, communication or similar or associated service within Underground Utility District No.95-1 on or before twelve 12) months from the date of adoption of this Resolution; and RESOLVED, FURTHER, that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No.95-1 of the adoption of this Resolution within ten 10) days after the date of such adoption; and Said City Clerk shall further notify, if necessary, said property owners that if they or any person occupying such property desire to continue to receive electricity, communication or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on tile with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution together with a copy of said Chapter 13.08 of the City of Baldwin Park Municipal Code to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. The Underground District herein created is in the general public interest for the following reasons: 1. The under grounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities: and 2. The streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic: and 3. The said streets, roads or rights-of-way adjoin or pass through a civic area: and 4. That the City of Baldwin Park pay as part of the underground utility project to extend the private service laterals for a distance up to 100'. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution PASSED, APPROVED AND ADOPTED on March 15 1995 Mayor ATTEST LINDA L GAIR, CITY CLERK STATE OF CALIFORNIA COUNTY OF LOS ANGELES ss CITY OF BALDWIN PARK I, LINDA L.
