HomeMy WebLinkAbout1995 071 CC RESO1995 071 CC RESO(Ìì³Ì RESOLUTION NO.95-71 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF BALDWIN PARK AND SDC PARTNERS, LTD., AND DAYTON HUDSON TARGET) PERTAINING TO THE DISPOSITION AND DEVELOPMENT OF AGENCY-OWNED REAL PROPERTY LOCATED IN THE CITY OF BALDWIN PARK, AND MAKING FINDINGS THEREFOR AS REQUIRED BY HEALTH AND SAFETY CODE SECTION 33433 WHEREAS, the Redevelopment Agency of the City of Baldwin Park the Agency") is a public body, corporate and politic, organized and existing under the California Community Redevelopment Law Health and Safety Code Section 33000 et seq.) NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Baldwin Park as follows: SECTION 1. The Agreement will assist in the elimination of physical and economic blight consistent with the requirements of the CRL. SECTION 2. The Agreement is consistent with the Agency's adopted AB1290/SB732 Implementation Plan. SECTION 3. The consideration is not less than the fair market value at the highest and best use under the Redevelopment Plan and with the covenants and conditions and development costs authorized by the Agreement. Under the Agreement, the Property will be sold to SDC at less than its current fair market value. In consideration thereof, SDC shall develop the Property for commercial use and make infrastructure improvements on the Property including assisting in the removal of hazardous materials on the Property. The agreement, a copy of which is on file with the Agency Secretary, is hereby approved. SECTION 5. The Board of Directors consents to the Agency's authonzation and direction to the Agency Executive Director to take such actions and execute such documents as may be necessary to implement and effect the Agreement on behalf of the Agency. City staff is also authorized and directed to take such actions and execute such documents as may be necessary to implement and effect the Agreement.
