HomeMy WebLinkAbout1995 082 CC RESO1995 082 CC RESO(Ìì·W RESOLUTION NO.95-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE CONDITIONS FOR TENTATIVE PARCEL MAP 1286 WHEREAS, an application for Tentative Parcel Map 1286 was submitted by Domingo Rodriguez and Irene Mendez for certain real property located at 3706-3708 Rhodes Lane in the City of Baldwin Park described more particularly on file with the Director of Public Works; and WHEREAS,the application is to subdivide the lot and create two separate parcels within an R-1 Zone; and WHEREAS the applicant has two existing housing units and, after subdividing, each lot will have one single residential unit; and WHEREAS,on August 9, 1995, the Advisory Agency held a duly noticed public hearing and voted to conditionally approve this application; and WHEREAS, Domingo Rodriguez and Irene Mendez filed to appeal to the City Council the decision of the Advisory Agency; and WHEREAS, a duly noticed public hearing was held on said appeal by the City Council on October 4,1995; and NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Findings of Fact. Based upon the evidence presented and the applicable staff reports, as well as, each member of the City Council being familiar with the property, it is recommended that Parcel Map 1286 be approved with the conditions as listed. 1. All conditions of the State Map Act and the City's Subdivision Ordinance must be met prior to recordation. 2. A title report/guarantee showing all fee owners and interest holders must be submitted when a Final Map is submitted for plan check. This account must remain open until the Final Map is filed with the County Recorder. An updated title report/guarantee must be submitted ten 10) working days prior to Final Map approval. 3. The Final Map shall be based on a field survey. 4. All surveying for the proposed development must be done by the property owners' surveyor, including the establishment of centerline ties. 5. The surveyor's closure sheets must be enclosed with the Final Map. 6. New boundary monuments must be set in accordance with the City standards and subject to approval by the City Engineer. All easements existing prior to Final Map approval must be identified. If an easement is blanket or indeterminate in nature, a statement to that effect must be shown on the Final Map in lieu of its location. 8. Owner shall obtain a zone variance from the Sections 153.053.B and 1 53.053.F of the Baldwin Park Municipal Code. SECTION 2. After the Final Map records, a sepia and two 2) blueline prints shall be submitted to the Engineering Division at no cost to the City. Final occupancy will not be granted until the recorded Map is received by the Engineering Division. SECTION 3. The Final Map must be recorded within 24 months or all proceedings shall be terminated. SECTION 4. That the City Council relied upon the Administrative Records and the evidence presented at the public hearing in making the findings of fact and in reaching the conclusion that the appeal should be approved. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and shall forward a copy to the Director of Public Works and to the applicant.
