HomeMy WebLinkAbout1996 032 CC RESO1996 032 CC RESO(Ìì³ RESOLZON NO.96-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO LEVY AND COUNCIL ASSESSMENTS FOR FISCAL YEAR 1996-97 WITHIN THE CITYWIDE BUSINESS IMPROVEMENT AREA OF THE CITY OF BALDWIN PARK WHEREAS, the City of Baldwin Park has established within the accordance with the Parking and Business Improvement Area Law of 1979, superseded and rep]aced by the Parking and Business Irnproverrient Area Law of 1989 the Act") Str. & H. Code Sections 36500 et seci.); WHEREAS, the Act authorizes the City Council to impose annual assessments upon all businesses located within the Area; WHEREAS, the City Council has appointed an advisory board to make recommendations to the Council on the expenditure of revenues derived from the evy of assessments and on the method and basis of levying the assessments; WHEREAS, the advisory board has caused to be prepared and filed with the City a report which, among other things, proposes certain activities and improvements for Fiscal Year 1996-97, estimates the cost of providing the improvements and activities, and proposes a method and basis of levying the assessment; and WHEREAS, the City staff has additionally proposed improvements and activities to be flinded by revenues derived from the levy of assessments. NOW, THEREFORE, the City Council the City of Baldwin Park does hereby resolve as follows: SECTION 1. It is the intent of the City Council to levy and coflect assessments within the Area for Fiscal Year 1996-97, but to do so at rates approximately one-half of previous years' levies. SECTION 2. The proposed improvements and activities to be flinded by the revenues derived from the levy of assessrnents may include, but are not limited to, general civic promotion programs and community, cu]tural and musical special events, such as the holiday decorations for city streets and facilities, community newsletters, local access cable television programming, promotion of the Business Crime Prevention program, city beautification programs, participation in the San Gabriel Valley Commerce and Cities Consortium, as well as the development and maintenance of business promotions and aids directed at assisting existing businesses and locating new businesses within the City of Baldwin Park. SECTION 3. The Citywide Business Improvement Area includes all of the territory within the exterior boundaries of the City of Baldwin Park. SECTION 4. The report o'the alvisory boardisonlile with the Clerk of the City and provides a flill detailed description of the improvements and activities to be provided for Fiscal Year 1996-97, and the proposed assessments to be levied upon businesses within the Ae,ea for that fiscal year. The proposed basis of levying the assessments is approximately one-half of past years' levies; that is, it is a charge eqtaal to a certain percentage 30%, 38%, or 45%) depending upon the classification of the business, as opposed to previous rates of 60%, 75%, and 90% of the ordinary business license tax applicable to each respective business. SECTION 5. A public hearing regarding the proposed activities and improvements for Fiscal Year 1996-97 and on the levy of the proposed assessments for that fiscal year shall be held on June 5, 1996, at 7:00 oZock pm. at the City Hall of the City of Baldwin Park. At said public hearing, testimony of all interested persons regarding the proposed improvements and activities and the proposed method and basis of levying the assessments will be heard. At the public hearing, protest may be made, either orally or in writing, by any business owner against the flirnishing of specified types of improvements or activities within the Area or against the levy of the proposed assessments. Each written peetest saul contain a description of the business in which the person subscribing the protest is interested sufficient to identity the business and, if a person subscribing is not shown on the official records of the City as the owner of the business, the protest shall contain or be accompanied by written evidence that the person subscribing is the owner of the business. A written protest which does not comply with this section shall not be counted in determine a rnZjority protest If written pr,otests are received from the owners of businesses in the area which will pay 50% or more of the assessments proposed to be levied and protests are not withdrawn so as to reduce the protest to less than that 50%, no further proceedings to levy the proposed assessments shall be taken by the City Council for a period of one year from the date of the finding of the majority protest by the City Council. SECTION 6. The City Clerk shall give notice of the public hearing by causing this Resolution of Intention to be published once in a newspaper of general circulation in the City not less than seven days before the public hearing.
