A RESOLUTION OF THE CITY COUNCIL OF ThE CITY OF BALDWIN
PARK ADOPTING THE NONDISPOSAL FACILITY ELEMENT
REQUIRED BY THE CALIFORNIA INTEGRATED WASTE
MANAGEMENT ACT AS AMENDED BY ASSEMBLY BILL 3001
WHEREAS AS, e California Integrated Waste Management Act Act) as amended by AB 3001 required California cities and
counties to prepare the Nondisposal Facility Element NDFE); and
WHEREAS, the City intends or reserves" the right to use existing and proposed nondisposal facilities to reach its mandated
diversion goals; and
WHEREAS, a nondisposal facility is defined by PRC Section 40151 as any solid waste facility required to obtain a state
solid waste facility] permit other than solid waste disposal and transformation facilities; and
WHEREAS, the NDFE must include a description of new facilities and expansion of existing facilities needed to implement
the City's Source Reduction and Recycling E]ement SRRE); and
WHEREAS, a public hearing has been held to receive comments on the NDFE in accordance with PRC Sections 41730
et seq,
NOW, THEREFORE, the City Council of the City of Baldwin Park resolves as follows:
SECTION 1. The City has identified one or more new, existing, expanding or proposed nondisposal facilities
to use now or to the future to help implement its SRRE.
SECTION 2. The City has submitted its draft of the NDFE to the County of Los Angeles Local Task Force
and has addressed the Task Force's comments to the extent practicable.
SECTION 3. The City intends to append the NDFE to the City's SRRE at the time of the five year revision.
SECTION 4. The Nondisposal Facility Element is hereby approved and adopted by the City Council of the
City of Baldwin Park.
SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall forward a copy of this
resolution to the California Integrated Waste Management Board.
