HomeMy WebLinkAbout1996 052 CC RESO1996 052 CC RESO(Ì첿 RESOLUTION NO. 96-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE CIRCULATION ELEMENT OF THE GENERAL PLAN ADDING A BIKEWAY PLAN AND DELETING PORTIONS OF MAINE AVENUE AND GARVEY AVENUE. APPLICANT: CITY OF BALDWIN PARK; CASE NO.: AGP-97). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin park does hereby find, determine and declare as follows: a). That pursuant to the applicable provisions of the Planning Law Section 65300 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of considering the need for amendments to the Circulation Element of the General Plan; and b). That the City Council has conducted a noticed public hearing on the proposed amendment to said Circulation Element, Case No. AGP-97 on file with the Planning Division of the City, and an environmental analysis, as hereinafter described and has determined that the public interest requires the approval of Case No. AGP-97 to amend the Circulation Element of the General Plan: and c). That the proposed amendments would add a citywide Bikeway Plan Figure CEA), and would delete the portion of N. Maine Avenue and E. Garvey Avenue bounded by Baldwin Park Boulevard, Francisquito Avenue and the 1-10 Freeway from the Master Plan of Streets Figure CE-2): and d). That the amendments as proposed are consistent with the purposes and intent of the General Plan and its goals and objectives; and e). That the Amendments are required and are in the public interest and will promote the general welfare. I). That on June 26,1996, the Planning Commission conducted a duly noticed public hearing on said amendments and environmental review, and recommended that the City Council approve the same. SECTION 2. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact, relating to the Amendment. That the City Council, based upon its public review, does hereby approve the Negative Declaration, since there is no substantial evidence that the Amendments will have a significant impact on the environment. SECTION 3. That the Planning Commission recommends that the City Council approve the amendments to the Circulation Element of the General Plan, Case No. AGP-97. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution and forward a copy hereof to the Secretary of the Planning Commission.
