HomeMy WebLinkAbout1997 002 CC RESO1997 002 CC RESO(Ìì·P RESOLUTION NO. 97-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE DEVELOPMENT PLAN FOR THE SIERRA CENTER CASE NO.: DR-9; APPLICANT: HOLLYWOOD ENTERTAINMENT). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That an application Application") for a amendment to a development plan Plan") was submitted on behalf of the owner of certain real property, located at 3060 Baldwin Park Boulevard, in the City of Baldwin Park, described more particularly in the Application on file with the City Planner Planner"); and b) That the Application was sought to allow changes to the colors and materials of the exterior of Building D" of the Sierra Center; and c) That on December 11,1996, a duly noticed public hearing was held on the above said Application by the Planning Commission, and based upon the evidence presented, including applicable staff reports and each member of the Commission being familiar with the property, It was determined that the application should be granted, subject to the terms of this Resolution. d) That Z Planning Commission recommended that the City Council approve said amendments to the Plan. e) That on January 15,1997, a duly noticed public hearing was held on the above said Application by the City Council, and based upon the evidence presented, including applicable staff reports and each member of the Council being familiar with the property, it was determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of an amendment to a development plan were present and that the application should be granted, subject to the terms of this Resolution. SECTION 2. That the City Council hereby approves said amendments to the Plan. SECTION 3. That the amendments to the Plan be, and the same is hereby granted, subject to the following conditions: a) That the Subject Property shall be developed and maintained in substantial compliance with the terms and conditions identified in City Council Resolution No.95-73 except as modified as shown on Exhibit AZ, dated January 15, 1997; and b) If Hollywood:Video fails td occupy the building or should subsequently vacate the building, the applicant or property owner shall revert the building facade back to the color and material scheme which matches the balance of the shopping center within 30 days; and BIB] 37650-U01 1997-U02 002-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO1275-U03 DO1364-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 97-2-U05 JAN-U05 15-U05 1997-U05 1997 002 CC RESO(Ìì·P Resolution No 97-2 Page 2 of2 c) That the blue tile used for the mountain outline" shall match the tile at the base of the facade; and d) That all facade work shall be completed prior to final occupancy; and e) That the applicant shall sign a notarized affidavit within 30 days of the date of the City Council resolution stating that the applicant has read, understands and accepts all of the conditions of approval. SECTION 4. This project is Categorically Exempt from the California Environmental Quality Act pursuant to Article 19 of the State CEQA Guidelines. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and forward a copy hereof to the Secretary to the Planning Commission and the Applicant. PASSED AND APPROVED on January 15, 1997.
