BILLIARD AND POOL HALL REGULATIONS" OF THE BALDWIN PARK MUNICIPAL CODE APPLICANT: CITY OF BALDWIN PARK; CASE NO.: AZC-139). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the City of Baldwin Park hereinafter Applicant") heretofore filed an application Application") requesting approval of amendments to Sections 153.520 through 155.524, Billiard and Pool Hall Regulations", of the Baldwin Park Municipal Code; and b) That said application requested that Sections 153.523(G) and 155.523(I) of the Municipal Code be amended, and Section 153.523(L) be added to read, respectively' as follows: Z(G) Interior Signage. Signage informing the public of the prohibition on the use of drugs, smoking if prohibited) loud conduct, age restrictions, and hours of operation shall be posted and plainly visible to customers within the establishment In at least two locations." I) A minimum of four and one-half feet 4' 6" be maintained between all pool tables and between tables and cocktails tables, counters, walls, partitions, Z barriers or seating areas excluding moveable stools)." 1) Smoking is permitted In conjunction with a liquor license consistent with Labor Code Section 6404.5 and any other applicable local, state, or federal law. C) That on September 25, 1996 and October 23, 1996, the Planning Commission conducted a duly noticed public hearing upon said Application: and d) That the proposed changes would allow smoking in billiard halls and may be detrimental to the health and welfare of the residents, specifically teenagers, of Baldwin Park; and e) That the Proposed changes may be detrimental to the properties within the City; and f) That the proposed changes may not be consistent with the spirit and intent of the General Plan; and g) That on January 15,1997, February 5, 1997 and March 19, 1997, the City Council conducted a duly noticed hearing upon said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience and general welfare did not require the approval of the amendments to the Billiard and Pool Hall Regulations of the Code. SECTION 4. That the City Council hereby denies the amendments. The City Clerk shall certify to the adoption of this Resolution and shall forward a copy hereof to the Secretary to the Planning; Commission. PASSED AND APPROVED ON March 19,1997.
