OF THE CALIFORNIA STREETS AND HIGHWAYS CODE) INITIATING PROCEEDINGS TO FORM THE CITY OF BALDWIN PARK c:CITY WIDE PARK MAINTENANCE DISTRICT AND TO LEVY ASSESSMENTS WITHIN THE DISTRICT FOR THE 1997-98 FISCAL YEAR AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE WITH ARTICLE 4 OF CHAPTER 1 OF SAID ACT AND SECTION 4 OF ARTICLE XIIID OF THE CALIFORNIA CONSTITUTION WHEREAS, it is the intention of the City Council of the City of Baldwin Park to levy annual assessments for the 1997-98 fiscal year to pay for park maintenance; and WHEREAS, substantial changes in state law require the City Council to modify the City of Baldwin Park Citywide Landscaping and Lighting Maintenance District to form a new district for the purpose of park maintenance pursuant to the provisions of the Landscaping and Lighting Act of 1972; and WHEREAS, said Act requires that proceedings for the formation of an assessment district and the levy of annual assessments shall be initiated by resolution proposing formation of the district, describing the improvements of the proposed district specifying a distinctive designation for the district, and ordering the engineer to prepare and file a report in accordance with Article 4 of Chapter 1 of said Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park hereby proposes to form an assessment district and to levy and collect assessments against the lots and parcels of land within such district to pay for the cost and expense of the improvements described in Section 3 hereof for the fiscal year commencing July 1,1997 and ending June 30,1998, pursuant to the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code the Act') and as provided by Article XIIID of the California Constitution. SECTION 2. The boundaries of the proposed assessment district are coterminous with the boundaries of the City of Baldwin Park, and generally include all parcels within the City. The proposed assessment district shall be designated as the City of Baldwin Park Citywide Park Maintenance District." SECTION 3. The proposed improvements for the fiscal year 1997-98 are generally described as the maintenance of public parks and their facilities throughout the City. Proposed new improvements for fiscal year 1997-98 include reconstruction of Central Park West, improvement of park facilities, and upgrade of irrigation system. SECTION 4. The City Engineer is hereby ordered to prepare and file a report in accordance with Article 4 commencing with Sections 22565 et seq.) of the California Streets and Highways Code and Article XIIID, Section 4 of the California Constitution.
