HomeMy WebLinkAbout2002 037 CC RESO2002 037 CC RESO;¢f4£„RESOLUTION NO. 2002-037 A Resolution of the City Council of the City of Baldwin Park Authorizing Support of Assembly Bill 2185 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the California Regional Water Quality Control Board, Los Angeles Region hereinafter regional board") is one of nine regional boards in California authorized under the Porter-Cologne Water Quality Control Act the State Water Code), to protect surface and ground water quality in the Los Angeles Region; WHEREAS, regional board members serve part time for 4 year terms and meet 10 times per year to make decisions on water quality matters; WHEREAS, the regional board consists of 9 members appointed by the Governor and confirmed by the State Senate, and represent the following appointment categories: public member 1); water supply 3); water quality 1); industrial water use 1); recreation, fishing, and wildlife 1); irrigated agriculture; and municipal government 1). WHEREAS, the current composition of the regional board lacks adequate local public agency representation; WHEREAS, none of the current regional board members is an elected local government official, including the municipal government appointee; WHEREAS, previous municipal government appointees that were elected officials were recused from voting on matters affecting municipal government e.g., municipal NPDES permits) because of the perception that voting on such matters constitutes an inherent conflict of interest; WHEREAS, the current regional board is not geographically representative of the Los Angeles Region, in that only 2 of the 7 board members reside outside the City of Los Angeles: 1 in the City of Santa Monica, the other in the City of Carson there are no appointees from the San Gabriel Valley or from the Southeast portion of Los Angeles County); WHEREAS. Assembly Bill 2185, introduced by Assembly Member Ed Chavez D-La Puente), calls for modifying the board member appointment process for the regional board, to reflect the current board member appointment process similar to that of the South Coast Air Quality District; BIB] 37641-U01 2002-U02 037-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO8678-U03 DO9042-U03 C6-U03 RESO-U03 1/20/2003-U04 ROBIN-U04 2002 037 CC RESO;¢f4£„Resolution 2002-037 Page 2 WHEREAS. Assembly Bill 2185 would enable: 1) cities to select their own City" representative from Mayors and Council-members; 2) Los Angeles and Venture Counties to select a County Supervisor" to be their representative; and 3) wastewater treatment agencies to elect their own representative. WHEREAS, Assembly Bill 2185 would also enable public agency members to vote on matters affecting the local agencies they represent, without disqualification because of a conflict in interest. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK. CALIFORNIA. DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Authorize the Director of Public Works to send copy of this Resolution to each member of the Assembly Committee on Environmental Safety and Toxic Materials, the City's State Assembly Member, State Senator, and Governor, asking for their support in adopting AB 2185. Section 2. The City Clerk shall certify to the passage and adoption hereof.
