HomeMy WebLinkAbout2002 053 CC RESO2002 053 CC RESO(Ì슕RESOLUTION NO. 2002-053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF TWO 2) SINGLE FAMILY DWELLING UNITS ON AN R-1 SINGLE FAMILY RESIDENTIALLY ZONED LOT WITH GREATER THAN 10,000 SQ. FT. OF LOT AREA, APPLICANT: MY LOAN LAM; LOCATION: 4125 CENTER STREET; CASE NO.: CP-648) WHEREAS, an application for a conditional use permit CP-648) was submitted by My Loan Lam, property owner at 4125 Center Street, in the City of Baldwin Park the Property" or Site"), described more particularly in the application on file with the Planning Division Application"); and WHEREAS, the Application is to allow two 2) single family dwelling units on an R-1 Single Family Residentiatly zoned lot with greater than 10,000 of the lot area, pursuant to Section 153.052(A) of the City's Municipal Code; WHEREAS, on March 26, 2002, the Planning Commission held a duly noticed public hearing and voted to approve this Application and grant the conditional use permit CP-648); WHEREAS, Mary Dougherty filed a timely appeal of the Planning Commission's decision to the City Council, wherein the City Council received information and public testimony; WHEREAS, that a duly noticed public hearing was held on the above said Application by the City Council on June 5, 2002; HOW THERFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOVE AS FOLLOWS: SECTION 1. Based upon the evidence presented, including applicable staff reports and public testimony, and each member of the City Council being familiar with the Property, it is hereby determined that the following Findings of Fact have been determined. A. The Site 12,623 square-foot lot is adequate in size and shape to accommodate the two detached single-family dwelling units as the Site contains the required parking, on-site circulation, and open space; and B. That the Site has sufficient access to streets, highways and sidewalks adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use, as both units have access to Center Street which is designated as a local street in the City's General Plan; and BIB] 37763-U01 2002-U02 053-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO8678-U03 DO16149-U03 C6-U03 RESO-U03 5/21/2003-U04 ROBIN-U04 2002 053 CC RESO(Ì슕Resolution No. 2002-053 Page 2 C. That the proposed use will not have an adverse effect upon uses adjacent to the Property, in that the Site will be developed in accordance with the City's R-1 zone development standards and design guidelines, and the Site can accommodate the two dwelling units without creating unsightly views or otherwise negatively impact neighboring properties; and D. That the proposed use is consistent with the goals and policies of the Baldwin Park General Plan, in that the development preserves the low density quality of the existing single-family residential area, makes more efficient use of a deep lot, and the proposed density is no higher than the City's ability to provide the necessary services, utility, street capacities, and outdoor recreational spaces required for the affected areas. SECTION 2. That the Application, as herein above described be, and the same is hereby approved subject to the following conditions: A. That the Property shall be developed and maintained in substantial accordance with Exhibit A", dated June 5, 2002, unless otherwise revised herein by these conditions; and B. That the Applicant shall submit a detailed landscape/irrigation plan to the Planning Division for review and approval during the Plan Check phase of the project. The plan shall include an automatic irrigation system. The landscape plan shall indicate the size, location, number, and species of all trees, shrubs, ground cover, and any other plant life proposed; and C. That the six-foot high block wall surrounding the Property shall be decorative i.e. stucco covered with brick cap, slump stone, etc.) and subject to Planning Division review and approve. Applicant shall submit a detail of the wall plan during the plan check phase of the project; and D. That decorative paving shall be provided at the entrance of the driveway at least eight 8) feet in depth, along the width of the southerly most driveway; and E. That the Applicant shall provide a three-foot wide landscaped planter the length of the driveway along the south property line; and F. That the Applicant shall revise the floor and elevation plans as follows in order to reduce the potential impacts: 1. Eliminate the door along the west elevation; and 2. Relocate window in bedroom #4 from west elevation to south elevation; and 3. Relocate washer, dryer, and water heater to another area under the rear patio cover; and 4. Eliminate door into garage along north elevation and provide window size to be approved by the Planning Division) along the first story of the north elevation; and BIB] 37763-U01 2002-U02 053-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO8678-U03 DO16149-U03 C6-U03 RESO-U03 5/21/2003-U04 ROBIN-U04 2002 053 CC RESO(Ì슕Resolution No. 2002-053 Page3 The Applicant shall submit revised elevation and floor plan drawings to the Building and Planning Divisions noting the changes as mentioned above for review and approval; and G. That the Applicant shall comply with all conditions of approval within six 6) months after the date of approval of CP-648, or CP-648 shall become null and void and will be subject to revocation pending a public hearing by the Planning Commission and/or the City Council on appeal. Further, any costs associated with the revocation of this conditional use permit shall be paid by the Applicant and/or owner; and H. That the Applicant shall sign a notarized affidavit within twenty 20) days after the approval date of this resolution stating that the Applicant has read and accepts all of the conditions of approval. SECTION 3. The Secretary shall certify to the adoption of this Resolution and forward a copy hereof to the City Clerk and the Applicant.
