A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, CALIFORNIA. AUTHORIZING AN
INCREASE TO AB939 COMMERCIAL FEES IN THE CITY OF
BALDWIN PARK
WHEREAS. Amendment No. 2 to the franchise agreement with Waste Management
of the Pomona/San Gabriel Valley establishes an Integrated Waste Management AB939)
fee for the purpose of funding diversion programs and activities pursuant to and aimed at
meeting the mandates of AB939 legislation;
WHEREAS, the City Council desires to further expand and implement commercial
sector recycling programs pursuant to meeting the mandates of AB939; and
WHEREAS, the City Council desires to revise the AB939 fees related to commercial
sector trash hauling to finance said programs and activities.
NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK.
CALIFORNIA, DOES HEREBY RESOLVE. DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2: That the Integrated Waste Management AB939) fee shall be based
on 3% of the gross commercial and gross roll off service receipts;
SECTION 3: That the Integrated Waste Management AB939) fee shall be collected
and forwarded to the City of Baldwin Park by the City's franchise refuse hauler Waste
Management of the Pomona/San Gabriel Valley;
SECTION 4: That the fee established by this resolution shall become effective on
September 1,2002;
SECTION 5: That the City Clerk shall certify as to the adoption of the Resolution
and shall cause the same to be processed in the manner required by law.
