RESOLUTION NO. 2002-089
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK. CALIFORNIA.
REPEALING RESOLUTION NO. 2000-117
AND AMENDING THE CITY'S CONFLICT OF
INTEREST CODE TO REVISE THE
DESIGNATED POSITIONS FOR WHICH
STATEMENTS OF ECONOMIC INTEREST
ARE REQUIRED TO BE FILED
WHEREAS, the Political Reform Act of 1974, California Government Code
Section 81000 et seq. requires every state or local government agency to adopt and
promulgate a Conflict of Interest Code; and.
WHEREAS, on April 4, 1979 the City Council of the City of Baldwin Park adopted
Resolution No. 79-36 which established the Conflict of Interest Code for the City of
Baldwin Park by incorporating the provisions Division 6 of Title 2. California
Administrative Code Section 18730; and
WHEREAS, on March 2. 1988 the City Council adopted Resolution No. 88-20
which revised the City's Conflict of Interest Code to reflect changes in the law and to
update the list of positions for which Statements of Economic Interest are required to be
filed designated positions") and the financial disclosure categories for each designated
position; and
WHEREAS, on April 17. 1991, the City Council adopted Resolution No. 91-14
which revised the City's Conflict of Interest Code to update the list of positions for which
Statements of Economic Interest are required to be filed designated positions") and
the financial disclosure categories for each designated position; and
WHEREAS, on November 2. 1994. the City Council adopted Resolution No. 94-
118 which revised the City's Conflict of Interest Code to update the list of positions for
which Statements of Economic Interest are required to be filed designated positions")
and the financial disclosure categories for each designated position; and
WHEREAS, on December 16. 1998, the City Council adopted Resolution No. 98-
100 which revised the City's Conflict of Interest Code to update the list of positions for
which Statements of Economic Interest are required to be filed designated positions")
and the financial disclosure categories for each designated position; and
WHEREAS, on December 20, 2000. the City Council adopted Resolution No.
2000-117 which revised the City's Conflict of Interest Code to update the list of positions
for which Statements of Economic Interest are required to be filed designated
positions") and the financial disclosure categories for each designated position; and

WHEREAS, it is necessary to update Appendix A" of Resolution No. 2000-117
which contains the list of designated positions subject to the Conflict of Interest Code
and the financial disclosure categories applicable to each position in order to ensure
that the list accurately reflects existing positions.
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK,
CALIFORNIA. DOES RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 2000-117 is repealed in its entirety.
SECTION 2. The City's Conflict of Interest Code shall consist of the provisions of
2 California Code of Regulations the Code") and Exhibits 1 and 2 attached to this
Resolution, all of which documents are hereby incorporated by reference.
SECTION 3. Any future amendments to the City's Conflict of Interest Code
including, but not limited to. amendments to the designated positions list or to the
financial disclosure categories shall be made by resolution duly adopted by the City
Council of the Crty of Baldwin Park.
SECTION 4. The City Council hereby delegates to the City Clerk the authority to
carry out the duties of filing officer.
SECTION 5. Pursuant to the Code. any person holding a designated position,
including any person holding a designated position in an acting capacity, shall file a
Statement of Economic Interest with the City Clerk.
SECTION 6. Pursuant to the Code, all persons assuming or leaving designated
positions must file Statements of Economic Interest within thirty 30) days after
assuming or leaving the designated position.
SECTION 7. The City Clerk shall certify to the adoption of this Resolution and
enter it into the book of original resolutions.

Category 1
Persons in this category shall disclose all interests in real property within the jurisdiction
of the City. Real property shall be deemed to be within the jurisdiction if it is or any part
of it is located not more than two miles outside the City's boundaries or within two miles
of any land owned or used by the City. Form 700, schedules A-1; A-2; and B)
Category 2
Persons in this category shall disclose all income from and investments in businesses
that provide or sell services or supplies of the type associated with the job assignment
and utilized by the City. In addition, as to any business entity in which the person or his
or her spouse owns, directly, indirectly, or beneficially, a ten percent or greater interest.

income of the entity if the entity provides or sells services or supplies of the type
