HomeMy WebLinkAbout2002 111 CC RESO2002 111 CC RESO;¢f4ÝóRESOLUTION 2002-111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN ALLOWING THE CONSTRUCTION OF A NINE 9) UNIT SINGLE-FAMILY DETACHED RESIDENTIAL DEVELOPMENT AND ADOPTING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: JOE KWOK, REPRESENTING KOBA PROPERTIES; LOCATION: 3933 BRESEE AVENUE; CASENO.:DR-19). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application Application") for a Development Plan was submitted on behalf of the owners of certain real property, located at 3933 Bresee Avenue in the Crty of Baldwin Park, described more particularly in the Applications on file with the Planning Division; and b) That the Development Plan is requesting approval to allow the construction of a 9-unit Single-Family Detached Residential Development pursuant to Government Code Section 65450; and c) That on November 13, 2002. a duly noticed public hearing was held on said Applications by the Planning Commission, and based upon evidence presented including applicable staff reports and each member of the Commission being familiar with the properties, the Planning Commission recommended that the City Council approve the Development Plan; and d) That a duly noticed public hearing was held on said Applications by the City Council, and based upon evidence presented including applicable staff reports and each member of the Council being familiar with the properties, it was determined that the facts as required by the Baldwin Park Municipal Code for the granting of such Applications are present and that the Development Plan should be approved. SECTION 2. That the Development Plan, as herein described by and the same hereby is approved subject to the following conditions of approval. a) That the subject Property shall be developed and maintained in substantial compliance with Exhibit A", dated December 4, 2002; and b) That electric garage door openers shall be provided for each unit; and BIB] 37665-U01 2002-U02 111-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO8678-U03 DO8980-U03 C6-U03 RESO-U03 1/16/2003-U04 ROBIN-U04 2002 111 CC RESO;¢f4ÝóResolution No. 2002-111 Page 2 c) That sectional roll-up garage doors shall be provided for each unit. A minimum of four 4) doors with glass panels shall be provided throughout the site; and d) That the applicant shall submit a detailed Landscaping and Irrigation Plan upon the Plan Check submittal; and. e) That the applicant shall submit a copy of the proposed covenants, conditions and restrictions to the Planning Division; and f) That the CC&R shall reflect that any future addition to individual units shall be limited to a patio cover which shall not exceed 25% of the rear yard area and shall meet all zoning code requirements; and g) Provide the following information upon the Plan Check submittal: 1) Three 3) architectural plans and one 1) extra site plan for the Fire Department 2) Three 3) complete sets of Plans for the City. 3) Two sets of the following are required: i. Soil Reports ii. Structural Calculations iii. Title 24 Energy Calculations h) Provide a grading plan signed by a registered civil engineer; and i) Provide a soils report signed by a registered civil engineer; and j) Plant two 2) trees per City standards along the frontage of the property; and k) Provide a sewer plan signed by a registered engineer; and I) Provide a separate sewer lateral for the proposed new units; and m) Provide Street lights per City Master Plan; and n) Apply for a Tract Map for the proposed project; and o) Provide water service and gas service for the developmental area; and p) Grind VA" AC and repave V/z AC from curb to curb for the entire frontage of developmental area Bresee Ave.); and q) Remove existing driveway approach(es) not being utilized and replace with full height curb and gutter. All driveway approaches shall be constructed per Plan and shall meet ADA requirements; and BIB] 37665-U01 2002-U02 111-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO8678-U03 DO8980-U03 C6-U03 RESO-U03 1/16/2003-U04 ROBIN-U04 2002 111 CC RESO;¢f4ÝóResolution No. 2002-111 PageS r) Construct private street per City standard 3" AC over 4" aggregate base and install curb and gutter; and s) Install sidewalk and landscaped parkway on Bresee Avenue; and t) Provide all existing overhead utilities underground along the entire frontage of the property Bresee Ave.); and u) That the applicant shall supply the Baldwin Park Police Department with an access mechanism for both the pedestrian and vehicle gates; and v) That the applicant shall submit to all Los Angeles County Fire Department comments. w) That the applicant shall comply with all conditions of approval within one 1) year after the date of approval or approval of this Development Plan shall become null and void and will be subject to revocation pending a hearing by the Planning Commission or the City Council on appeal. Furthermore, any costs associated with the revocation of this Development Plan shall be paid by the applicant and/or owner; and x) That the applicant shall sign a notarized affidavit within twenty 20) days after the approval date of this resolution stating that the applicant has read and accepts all of the conditions of approval. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact. That the City Council, based upon its public review, does hereby find that said Mitigated Negative Declaration has been prepared and was considered pursuant to the provisions and guidelines of the California Environmental Quality Act. and hereby adopts the Negative Declaration since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and forward a copy hereof to the Secretary of the Planning Commission and the Applicant.
