HomeMy WebLinkAbout2003 025 CC RESO2003 025 CC RESO(ÌìŠ|RESOLUTION 2003-025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN ALLOWING THE CONSTRUCTION OF A FOUR 4) UNIT SINGLE-FAMILY DETACHED RESIDENTIAL DEVELOPMENT AND ADOPTING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: BOWDEN DEVELOPMENT; LOCATION: 4611 MAINE AVENUE; CASE NO.: DR-20). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application Application") for a Development Plan was submitted on behalf of the owners of certain real property, located at 3933 Bresee Avenue in the City of Baldwin Park, described more particularly in the Applications on file with the Planning Division; and b) That the Development Plan is requesting approval to allow the construction of a 4-unit Single-Family Detached Residential Development pursuant to Government Code Section 65450; and c) That on march 26, 2003, a duly noticed public hearing was held on said Applications by the Planning Commission, and based upon evidence presented including applicable staff reports and each member of the Commission being familiar with the properties, the Planning Commission recommended that the City Council approve the Development Plan; and d) That a duly noticed public hearing was held on said Applications by the City Council, and based upon evidence presented including applicable staff reports and each member of the Council being familiar with the properties, it was determined that the facts as required by the Baldwin Park Municipal Code for the granting of such Applications are present and that the Development Plan should be approved. SECTION 2. That the Development Plan, as herein described by and the same hereby is approved subject to the following conditions of approval. a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A", dated March 26, 2003; and b) That electric garage door openers shall be provided for each unit; and BIB] 37763-U01 2003-U02 025-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO9347-U03 DO16143-U03 C6-U03 RESO-U03 5/21/2003-U04 ROBIN-U04 2003 025 CC RESO(ÌìŠ|Resolution 2003-025 Page 2 c) That sectional roll-up garage doors shall be provided for each unit; and d) That the applicant shall submit a detailed Landscaping and Irrigation Plan upon the Plan Check submittal; and e) That the applicant shall submit a copy of the proposed covenants, conditions and restrictions to the Planning Division; and f) That the CC&R shall reflect that any future addition to individual units shall be limited to a patio cover which shall not exceed 25% of the rear yard area and shall meet all zoning code requirements; and g) Provide the following information upon the Plan Check submittal: 1. Three 3) architectural plans and one 1) extra site plan for the Fire Department 2. Three 3) complete sets of Plans for the City. 3. Two sets of the following are required: i. Soil Reports ii. Structural Calculations iii. Title 24 Energy Calculations h) Construct driveway approach per plan. All driveway approaches shall meet ADA requirements; and i) All existing driveway approaches not being utilized shall be replaced with full height curb and gutter; and j) Submit a parcel map to the Engineering Division; and k) All new units must have independent sewer laterals; and I) Provide gas service and water service to the new units; and m) Provide a Sewer Plan signed by a registered engineer; and n) Submit a Grading Plan signed by a registered engineer; and o) Re-construct sidewalk on Ohio Street and provide a landscaped parkway along the entire frontage of the property; and p) The landscaped parkway along Ohio Street shall provide irrigation; and q) Provide one 1) streetlight per City master plan; and r) Resurface and improve alley with swale) along the frontage of the orooertv- and BIB] 37763-U01 2003-U02 025-U02 CC-U02 RESO-U02 LI3-U03 FO8417-U03 FO9347-U03 DO16143-U03 C6-U03 RESO-U03 5/21/2003-U04 ROBIN-U04 2003 025 CC RESO(ÌìŠ|Resolution 2003-025 Page3 s) All new utilities shall be provided underground; and t) That the applicant shall comply with all Los Angeles County Fire Department comments. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact. That the City Council, based upon its public review, does hereby find that said Mitigated Negative Declaration has been prepared and was considered pursuant to the provisions and guidelines of the California Environmental Quality Act, and hereby adopts the Negative Declaration since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and forward a copy hereof to the Secretary of the Planning Commission and the Applicant.
