DECLARING ITS SUPPORT FOR THE RELEASE OF THE CHIHUAHUA DOGS TO CHIHUAHUA RESCUE.COM FOR REHABILITATION AND EVENTUAL ADOPTION BALDWIN PARK CHIHUAHUA RESCUE EFFORT WHEREAS, in November, 2002,174 purebred Chihuahuas were confiscated from a local breeder, Emma Harter, a woman in her mid-70's, from her Acton home in California; and WHEREAS, Harter never spayed or neutered any of the Chihuahuas, thinking it would drive them crazy" this in turn led to inbreeding; and WHEREAS, until such time that there were over 200 dogs, the dogs were removed from her home due to her failing health and inability to take care of the animals properly; and WHEREAS, the Chihuahuas were found in horrible conditions, un-socialized, and scared to death; and WHEREAS, for the last eight months, the Chihuahuas they have been kept at the Baldwin Park Animal Shelter, surviving on cement floors without blankets; and WHEREAS, these Chihuahuas were scheduled to be released on Thursday, July 10, 2003 by the judge in charge of this case under the conditions that nonprofit organizations are able to provide foster homes and transportation for each and every one of the dogs; and WHEREAS, the release date was pushed back indefinitely and a second hearing was scheduled for July 17, 2003; and WHEREAS, on July 17th, all affected parties went to court with an understanding that an Agreement would be made with the District Attorney, County Animal Control, and Emma Harter. the breeder of the Chihuahuas that they were seized from; and WHEREAS, an Agreement was reached between the District Attorney's office, Animal Control, and County Officials, however, Emma Harter refused to sign the Agreement because of her desire to use the dogs' disposition as part of her criminal trial. NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK HEREBY RESOLVES AS FOLLOWS: SECTION 1. The City of Baldwin Park hereby declares its support for the release of these dogs to rescue for rehabilitation and eventual adoption. That the City Clerk shall certify to the adoption of this Resolution and forward a copy to the Judge Hearing the Case in Division 3 of the Los Angeles County Superior Court, 1040 West Avenue J". That the City Clerk shall enter this resolution into the original book of resolutions.
