A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK APPROVING A MODIFICATION TO THE
CONDITIONS OF APPROVAL OF RESOLUTION 2002-101
CASE NO.: DR-17; LOCATION: 3714V2-3738 MAINE
AVENUE).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does hereby find,
determine and declare as follows:
a) That the Developers of the certain real property located at 3714
V2-3738 Maine Avenue met with City staff and requested that the number of
affordable dwelling units in the Maine Avenue Project be reduced from three
3) units to one 1) unit; and
b) That the Planning Commission conducted a duly noticed public
hearing upon said matter and recommended that the request be denied; and
c) That the City Council conducted a duly noticed public hearing upon
said matter, and based upon the evidence presented and each member
being familiar with the subject matter, the City Council determined that the
said applications should be granted, subject to the terms and conditions
hereinafter set forth.
SECTION 2. That the City Council does hereby modify condition i) of City Council
Resolution 2002-101 to read as follows:
That 20% of the total units 3 units) a minimum of one 1) dwelling
unit must be occupied by individuals with no more than 120% of the
median income for the County of Los Angeles.
SECTION 3. That the above described condition of approval is hereby approved,
and that all other conditions of City Council Resolution 2002-101 shall remain in full force
and effect.
SECTION 4. That the City Council relied upon the Administrative Record, and
evidence presented at the public hearing and in reaching the conclusion that the
modification to condition i) of City Council Resolution 2002-101 should be approved.
SECTION 5. That the City Clerk shall certify to the adoption of this resolution and
shall forward a certified copy hereof to the Secretary of the Planning Commission.
