A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK EXPRESSING SUPPORT FOR SENATE
BILL SB 148 SCOTT) WHICH WOULD AUTHORIZE
LOCAL JURISDICTIONS TO AMORTIZE, TERMINATE OR
IMPOSE CONDITIONS ON LIQUOR STORES NOT
CURRENTLY SUBJECT TO LOCAL REGULATIONS.
WHEREAS, The Alcoholic Beverage Control Act states that the Department of
Alcoholic beverage Control has responsibility to administer and enforce state laws with
respect to alcoholic beverages, including licensing.
WHEREAS, the City of Baldwin Park's incorporation in 1956 and 1981. several
establishments engaging in the off-site sales of alcoholic beverages were established.
WHEREAS, in 1981, the City*s zoning ordinance was amended to require that ail
new establishments proposing to sell alcoholic beverages obtain a conditional use
permit.
WHEREAS, current state law precludes Baldwin Park from requiring that
establishments in existence prior to 1981 which are engaged in the sale of alcoholic
beverages meet the current zoning code requirements and obtain a conditional use
permit.
WHEREAS, SB 148 would authorize Baldwin Park to provide for a reasonable
amortization period and termination or imposition of conditions on legal non-conforming
uses pursuant to a validly enacted zoning ordinance.
WHEREAS, the City Council of the City of Baldwin Park supports SB 148; and
NOW. THEREFORE. IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BALDWIN PARKAS FOLLOWS:
Section 1. The City of Baldwin Park hereby declares its support for the
adoption of SB 148 by the California Legislature.
Section 2. That this resolution shall become effective immediately upon
passage and adoption.
