A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DELEGATING TO THE
CHIEF EXECUTIVE OFFICER THE AUTHORITY TO
DETERMINE WHETHER DISABILITY IS INDUSTRIAL
AND THE AUTHORIZATION TO CERTIFY THE SAME
TO THE PUBLIC EMPLOYEES' RETIREMENT
SYSTEM
WHEREAS, the City of Baldwin Park hereinafter, referred to as Agency") is a
contracting agency of the California Public Employees* Retirement System;
WHEREAS, the Public Employees' Retirement Law requires that a contracting
agency determine whether an employee of such agency, in employment in which
he/she is classified as a local safety member, is disabled for purposes of the Public
Employees' Retirement Law and whether such disability is industrial" within the
meaning of such law:
WHEREAS, the City Council has pursuant to Resolution No. 2000-06 determined
to delegate the authority to make such determinations to the incumbent in the position
of Chief Executive Officer CEO) or his/her designee. but State law has been amended
to change the statutory designations set forth in Resolution No. 2000-06;
NOW. THEREFORE, the City Council of the City of Baldwin Park hereby
resolves as follows:
Section 1. The City Council does hereby delegate to the incumbent of the
position of Chief Executive Officer CEO) or his/her designee authority to make
determinations under Section 21152 c), Government Code. on behalf of the Agency, of
disability and whether such disability is industrial and to certify such determinations and
all other necessary information to the Public Employees' Retirement System; and
Section 2. The CEO is authorized to make applications on behalf of the
Agency for disability retirement of all employees and to initiate requests for
reinstatement of such employees who are retired for disability.
Section 3. Resolution No. 2000-06 is hereby rescinded, provided, however,
that such rescission shall not be deemed to affect in any way any determination made
pursuant to the provisions thereof.
Section 4. The City Clerk shall certify to the adoption of this Resolution.
